چکیده:
افزایش ناپایداری و تهدیدهای زیستمحیطی بشر را ناگزیر کرده است که برای استمرار حیات خویش چارهاندیشی کند. امروزه شیوههای متعددی برای رویارویی با بحرانهای محیطزیست و بهبود وضعیت آن مطرح میشوند. در این میان رویکرد توسعه فرهنگ زیستمحیطی با بهرهگیری از ظرفیت سازمانهای مردمنهاد زیستمحیطی (سمنها) رویکردی است کمهزینه، فراگیر و با مقبولیت اجتماعی بالا که میتواند با حمایتهای گسترده دولت، بستری مناسب جهت حفاظت از محیطزیست کشور قلمداد شود. در این مقاله با استفاده از روش توصیفی ـ تحلیلی به این سؤال پاسخ داده میشود که «دولت برای ارتقاء و گسترش مشارکت سازمانهای مردمنهاد زیستمحیطی چه تعهدات حمایتی بر عهده دارد؟». با بررسی پرسش مذکور این نتیجه به دست میآید که در نظامهای حقوقی سبز، دولتها با توجه به ظرفیت سازمانهای مردمنهاد، به این سازمانها امکان مشارکت در مقرراتگذاری، مشارکت در طرح دعوا و نظارت و پایش اجرای قوانین و مقررات را میدهند. در نظام حقوقی ایران برای سازمانهای مردمنهاد زیستمحیطی، نقش قضایی (حق اعلام جرم) و مشارکت در تهیه و تدوین و اجرای برنامههای حفاظت از محیط زیست پیشبینی شده است. با این وجود، کاستیها و استثنائات و همچنین امکان حذف و تغییر فهرست سمنهای فعال در حوزه محیطزیست توسط مقامات دولتی میتواند موجب خدشه در تعهدات دولت و مهمتر نیل به هدف محیطزیست سالم و سبز شود. در این مقاله نگارندگان به بررسی مبانی و الزامات مربوط به تحلیل چالشهای مذکور و ارائه پیشنهاد میپردازند.
Increasing the volatility and environmental threats of the human being has made it necessary to persevere in their lives. Today, there are many ways to deal with environmental crises and to improve the situation. In the meantime, the approach of developing environmental culture by utilizing the capacity of environmental NGOs is a low-cost, inclusive and highly societal approach that can be considered as an appropriate basis for protecting the country's environment through state-sponsored support. In this paper, using the descriptive-analytical method, this question is answered: "What are the supporting and supporting tasks for the government to promote and promote the participation of the organizations of the environmental NGO?" By examining the question, the result is that in the system Green law, governments, given the capacity of NGOs, give these organizations the opportunity to participate in regulation, participation in the lawsuit and monitoring and enforcement of laws and regulations. In the legal system of Iran for environmental NGOs, the role of the judiciary (the right to charge a crime) and participation in the preparation and implementation of environmental protection programs are foreseen. Nevertheless, the shortcomings and exceptions, as well as the possibility to remove and modify the list of active environments in the field of environment by government officials, can undermine government commitments and, more importantly, achieve the goal of a healthy and green environment. In this article, the authors analyze the foundations and requirements for analyzing the challenges and proposing a proposal.

از جمله تأثيراتي که سمن ها بـر روي دولت مي گذارند در زمينه سياست گذاري و قانونگذاري به خصوص در حـوزه محـيط زيست است که ميتوان براي سازمانهاي مردمنهاد در مقرراتگذاري و پيشنهاد قوانين مربوط به حوزه محيط زيست ، نقش هاي جدي در نظـر گرفـت ( ,Delisle and others ١٨.
در همين راستا در نظام حقوقي ايران نيز براي سازمانهاي مردمنهاد زيست محيطي، نقش قضايي (حق اعلام جرم) و مشارکت در تهيه و تدوين و اجراي برنامه هاي حفاظت از محيط زيست (موضوع بند ط ماده (٣٨) قانون برنامه ششم توسعه اقتصادي، اجتماعي، فرهنگي) پيش بيني شده است .
