چکیده:
تحقیق پیشرو به بررسی حکم جواز تقدیم طواف حج و سعی بین صفا و مروه بر وقوف در سرزمین عرفات و مشــعر میپردازد. تتبع در کلمات فقها نشان میدهد که درباره حکم تقدیم این مناسک، اختلاف هســت. از دیدگاه مشهور فقها، تقدیم این مناسک در حال اختیار، برای عموم حجگزاران جایز نیست. آنان با استناد به برخی روایات صحیح، معتقد شدهاند که فقط حجگزاران معذور همچون سالخوردگان، افراد مریض و معلول و بانوانی که از پیشامد قاعدگی ترساناند، میتوانند مناسک مورد گفتگو را بر وقوفین مقدم سازند؛ اما در مقابل، برخی فقها اعتقادشــان بر این امر سامان یافته که تقدیم طواف حج و سعی، برای عموم حجگزاران جایز و البته مکروه اســت و افضل این اســت که حجگزاران، چنانچه عذری ندارند، این مناسک را به تاخیر اندازنــد و در زمان خودش انجام دهند.
نتایج این تحقیق، که به صورت کتابخانهای ونرمافزاری و با تحلیل ادله و روایات صورت گرفته، بیانگر این است که اسناد شرعی دال بر جواز تقدیم، با نظر مشهور فقها مساعد نیست و جواز تقدیم در حال اختیار، هرچند با کراهت همراه است، مطابق صواب به نظر میرسد.
The forthcoming study examines the ruling on the permission to perform Tawaf of the Hajj and sa’i between Safa and Marwa over wuqufin in Arafat and Mash’ar. The words of the jurists reveal different opinions regarding the ruling on the priority of performing these rituals. From the popular point ofview of the jurists, it is not permissible for the public to perform these rituals in their own time. Based on some authentic narrations, the jurists believe that only the excused pilgrims such as the elderly, the sick, the disabled, and women who are afraid of the occurrence of menstruation can put the rituals before wuqufin; on the contrary, some other jurists believe that it is permissible, and of course disgusting, for pilgrims to perform Tawaf of the Hajj and sa’i before wuqufin; and pilgrims, if they have no excuse, should delay these rituals and perform them in their own time. The findings of this library-andsoftware-based research by analyzing the evidence and narrations indicate that the religious documents indicating the permission of priority of performing the rituals are not in line with the well-known opinions of jurists and the permission of perfuming rituals in their own time, albeit disgusting, seems closer to the spiritual merit (Thawab).
