چکیده:
زمینه و هدف: حیله در نزد فقها چارجویی مخفیانهای است که میتواند از طرق مثبت یا منفی صورت گیرد، گاه در عرف عام مذموم است، گاه از آن به حفظ ظاهر قوانین شرع یاد میشود.
مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق بهصورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات بهصورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: مشهور فقهای امامیه آن را مجاز ولیکن، حلیها، مقدس اردبیلی، وحید بهبهانی و امام خمینی (ره) قائل به حرمت حیل در باب ربا میباشند. امام خمینی (ره) با محک عقل حیل را، ظلم بر ربا دهنده میدانند و آن را حرام و مردود دانسته همان نظری که حنبلیان و مالیکان دارند. از طرفی حنفیها، مشهورند به استفاده از حیل شرعی، و شافعی مسلکها را پیروان حنفیها میدانند.
نتیجهگیری: بنا بر دلایل عقلی و نقلی مشهور فقهای مذاهب خمسه، بر این نظر اتفاق دارند که حیل در مقامی که به اصل دین و مقاصد الشریعه لطمه وارد کند و موضوع حکم را عوض کند و انهدام اهداف الهی را در بر داشته باشد باطل و حرام است و هیچ ادلهای بهطور مطلق دال بر مشروعیت یا عدم مشروعیت، حیل نمیباشد.

Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: Moqaddas Ardabili, Vahid Behbahani and Imam Khomeini believe in the sanctity of trickery about usury. Imam Khomeini, by testing the intellect of trickery, considers oppression on usurers and considers it forbidden and rejected, the same theory that The Hanbalis and the Malikis, on the other hand, the Hanafis, are known for using the Shari'a trick, and the Shafi'is consider the sects to be the followers of the Hanafis. Conclusion: It is clear that hail is void in a position that harms the principle of religion and the purposes of Sharia and changes the subject of the ruling and includes the destruction of divine purposes, and no evidence at all indicates legitimacy or illegitimacy.
