چکیده:
هدف از تحقیق حاضر بررسی مطالعه تطبیقی مسئولیت مدنی اشخاص حقوق عمومی نسبت به خسارات ناشی از سیل است. اگرچه ماهیت سیل به عنوان یکی از بلایای طبیعی و حوادث فورس ماژور تغییر نکرده است اما چشم انداز و نوع نگرش انسان بدان همواره دچار تغییر و تحول است و با توجه به میل بشر به رفاه و حفظ ایمنی وی رفته رفته انتظارات مردم به تعهدات اشخاص حقوق عمومی(دولت، شهرداری ها، وزارتخانه ها و موسسات انتفاعی دولت) و ایجاد مسئولیت برای آن را بیشتر میکند. پرسشی که مطرح می گردد این است که آیا می توان بر اساس رویکرد فقهی-حقوقی موجود اشخاص حقوق عمومی را در برابر سیل مسئول قلمداد نمود؟در پاسخ فرض براین است که مهم ترین قواعد فقهی که مبنای مسئولیت مدنی می تواند قرار گیرند، «قواعد مشهور»، «لاضرر»، «اتلاف»، «تسبیت»، «ضمان ید» و«ضمان غرور» و اهم مبنای حقوقیس مسئولیت مدنی شامل نظریات خطر، تقصیر و تضمین حق می باشد و با وجود این مبانی اشخاص حقوق عمومی در برابر سیل مسئول هستند و بر اساس قانون با استفاده از تکنولوژی و علم در جهت کاهش آثار بلایای طبیعی، مقابله، امدادرسانی ... تلاش و همکاری های لازم را به عمل آورند.
