The first volume is dedicated to discussions on conceptualization, methodology, the nature of family, the foundations and sources of jurisprudence and family law, rule-making (hukm-ology), subject-matter (mawdu-ology), and the relationship between jurisprudence and other sciences.
Here, the philosophy of law places legal science as its subject of study, and matters such as epistemological foundations and the methodology of understanding and interpreting this field are studied and researched.
However, today, with the emergence of schools, systems, methods, and the evolution of various sciences—ranging from sciences governing understanding to sciences observing human social relations—the emergence of new social institutions, changes in social structure, the emergence of theories of the state, political-geographical borders, the specialization of legal, ethical, sociological, and psychological sectors of the family, and dozens of other matters on one hand; and the movement of individuals across different environments and countries and involvement with various other issues of legal systems on the other, many issues have been raised for family law.
This situation, although perhaps acceptable in the past because the principles and foundations of family jurisprudence were not widely discussed, today, due to comprehensive scientific growth and expansion, the emergence of various schools of thought, social movements, and the specialization of scientific fields, has placed new dimensions of discussions before thinkers in jurisprudence and law of the family has placed.
A macro view of the jurisprudence and law of the family Jurisprudence, in all its branches, is based on sources and evidences that have expressed the governing rules in both specific and general forms.
