Nowadays, human rights pay deep attention to the issue of protecting individuals affected by natural disasters, as such incidents occur every year in corners of the world and bring with them significant financial and human losses. The protection of individuals against natural disasters in the contemporary world has witnessed the conclusion and implementation of a large number of international treaties and agreements, where the affected state bears the primary responsibility for protecting victims of natural disasters; of course, in case of the inability or unwillingness of the sovereign state to provide effective relief and the violation of the fundamental rights of the victims, the international community also has the duty to endeavor to support them through the channels of international relief organizations.

On this basis, the preamble and paragraph 2 of Article 10 of the draft articles on the protection of persons in the event of disasters, which was formulated in 2016 based on several years of studies by the International Law Commission, 2 emphasizes the principles of state sovereignty and, consequently, the primary and main role of the affected state in providing relief aid.
Accordingly, Article 11 of the draft articles on the protection of persons in the event of natural disasters, prepared by the International Law Commission, considers the affected state, in case of inability to provide relief to the victims, obligated to "seek" foreign assistance.
