چکیده:
the ethic of care, as a feminist theory of ethics, began its life in the 20th century. eva feder kittay, one of the main theoreticians of the theory, considers "being born of a mother" and "the experience of pure dependence" to be the common point of all human beings and describes care as having the necessary characteristics to consider it as work. this point of view set aside the liberal concept of work based on the relationship of ownership and production capability and presents another concept of work by emphasizing the mutual relationships of people, the fragility of the human kind and the nested dependencies of humans. by applying the concept of " doulia ", he considers the government to be committed to providing and taking care of the caregivers. in this research, regarding the use of the term "maternal job" in article 10 of women's employment policies in the islamic republic of iran, the legislator's approach to women's care, using library resources and descriptive-analytical methods, has been considered.
خلاصه ماشینی:
Eva Feder Kittay, one of the main theorists of the ethics of care, considers being born of a mother and the experience of pure dependency as the common ground for all humans, and describes care, given the inherent dependency of humans, as possessing the necessary characteristics to be regarded as work.
Among the philosophers of this school, Eva Feder Kittay has placed the concept of dependency as the pillar of her argumentative tent in the ethics of care, and she maintains that relationships based on dependency must be the precursor to public policymaking and the discussion regarding human equality.
Imposing the duty of care on states and linking care as a moral act with work as an entity possessing individual and simultaneously social and political aspects is a concept that can be specifically attributed to the American feminist Eva Feder Kittay.
In this article, using a descriptive-analytical approach and drawing upon library resources, we will test the legal position of the Iranian legislator regarding laws related to women's employment through the lens of care ethics with Eva Feder Kittay's reading.
Care Ethics and Political Theory The author believes that although the law reducing working hours for women does not seem to be aimed at recognizing care as work, at least in its enactment, it specifically provides the possibility for this subject to be raised within the Iranian legal system, particularly through the term "motherhood profession"; although this makes the discrimination between women employed in the public and private sectors in this regard unjustifiable.
