In this article, based on the noble verse 'And know that which you have taken as war booty' (wa'lamu annama ghanimtum), narrations, and the views of scholars, it is examined to whom the Khums—this important financial right and capital of the Islamic world—belongs, and how it should be spent. The principle of the obligation of Khums is agreed upon by both parties. Regarding its expenditure, four opinions from the Ahl al-Sunnah and five opinions from the Imami view are presented in this research. Among the opinions, the most important view is the famous one, which divides the Khums into six parts: a share for Allah the Merciful, a share for the Great Prophet, a share for the Imams, and three other shares for orphans, the poor, and the stranded. Based on the apparent meaning of the noble verse and the outward indications of the narrations, the theory of 'tasdis' (division into six) is held. Another view held by some great figures of the Islamic world is that Khums is a single, unified right belonging to the position of the Imamate, which, according to the view of the Imams, is spent for the benefit of Muslims. Among them, His Eminence Ayatollah al-Uzma Mohaghegh Kabli has scientifically scrutinized this theory and noted it as a correct opinion. The general goal of this article is to understand whether this important financial right, Khums, is divided into six parts according to the famous view, and whether this important capital belongs to those six categories mentioned in the noble verse, or whether, based on a realistic analysis of the noble verse, narrations, reason, and the practice of Muslims, Khums is a unified right for the Imam, to be spent according to the interests and the advancement of Muslim life.

An important view among the opinions is the famous view which divides Khums into six parts: a share for Allah the Merciful (swt), a share for the Noble Prophet (saw), a share for the Imam (as), and three other shares for the orphan, the poor, and the stranded, which, due to the apparent implication of the noble verse and the outward meaning of the hadiths, considers the division into six parts (tasdis) to be well-known.
َ و اعلموا أنما غنمتم من شي ء فأن لله خمسه و للرسول و لذي القربي و َ َ اليتامي و المساکين و ابن السبيل إن کنتم آمنتم بالله و ما أنزلنا علي عبدنا يوم الفرقان يوم التقي الجمعان و الله علي کل شي ء قدير (الأنفال آيه : ٤١)؛ و َ Know that whatever spoil comes to you, its Khums belongs to Allah, the Messenger, the kindred, the orphans, the needy, and the wayfarer, if you have believed in Allah and what We sent down upon Our servant on the Day of Criterion, the Day when the two armies met.
