چکیده:
In Islamic society, observing chastity and hijab is considered not only as a social norm but also as one of the religious necessities that holds a special position in religious and social culture. This has led the legislator in the year 1402 to criminalize certain behaviors and violations related to hijab and chastity by approving a new law. This article, with a descriptive-analytical approach, examines and critiques the criminological aspects of this law to analyze its social and delinquent dimensions. The research findings show that various factors such as cultural, social, economic, and psychological structures are involved in the formation and commission of the crimes mentioned in this law. Therefore, mere criminal confrontation cannot be an effective and sustainable solution for controlling this category of crimes. On the contrary, adopting preventive measures, including situational prevention (such as reforming public spaces and targeted supervision) and social prevention (such as education, culture building, and strengthening religious and social identity), can play an important role in reducing the tendency toward these types of violations. Accordingly, effective criminal policy should, instead of focusing solely on criminal aspects, be based on strengthening cultural and preventive infrastructures.
