چکیده:
Computer fraud is one of the oldest types of computer crime. the fast growth of computer technology and the informatics have not only made the possibility of misusing this technology greater , they have also paved the way for plenty of computer crime which are also difficult to pursue .Investigating such crimes need updated strategies and techniques . This research aims at studying the factors affecting computer fraud; moreover, the research aims at carrying out pathology of such crimes. In doing so, the research applied an analytical survey using questionnaires and interviews. The research hypotheses are also focused studying the capabilities of the detectives, the crime investigation equipment, interaction between judicial officials and the detectives, and the level of judges’ acquaintance with the technical and legal bases of these crimes.

In Iran as well, given the arrival of the extensive wave of information technology to the country, the prevalence of personal computer use, and the necessity of using network facilities (Internet), the existence of necessary laws and an appropriate legal framework in this regard is felt; therefore, considering the urgent need for updating domestic laws and coordinating police forces and specialists in the country in facing technology, the following suggestions are presented: 1- Computer crimes, especially computer fraud, must be carefully and with foresight prepared and formulated in criminal laws.
Based on this, the research hypotheses are also centered around 62 four main axes including the level of detectives' capability, the level of organizational equipment, the level of interaction Second Period Fourth Year, police with judicial authorities, the level of judges' familiarity with the technical and legal principles of this crime, using the Chi-square test and the Chi-square test have been investigated, the results obtained from the tests regarding the evaluation of the hypotheses indicate the influence of the aforementioned factors in the detection of this crime by officers and detectives.
