چکیده:
زمینه و هدف: لازمه رعایت عدالت در گواهی نویسی مصدومین مراجعه کننده به پزشکی قانونی، داشتن ضوابط و مقررات روشن، دقیق و جامع کارشناسی است، تا در موارد یکسان و در همه مکان ها و زمان ها، نظریه کارشناسی واحد و به تبع آن حکم قضایی یکسان صادر گردد. در این مطالعه دیدگاه ها و عملکرد فنی پزشکان قانونی را در موارد منتخبی از نظریات کارشناسی آنان در مورد تعیین ارش و دیه بررسی کرده ایم، تا میزان وحدت رویه کارشناسی را ارزیابی نماییم.
روش بررسی: این مطالعه از نوع توصیفی آینده نگر، در سال 1385 در قالب یک طرح پژوهشی مصوب در سازمان پزشکی قانونی کشور، با روش نظرسنجی از طریق پرسشنامه های پایلوت شده بدون نام، حاوی موارد منتخب نظریات کارشناسی پزشکان قانونی در تعیین ارش و دیه انجام گرفته است.
یافته ها: 99 نفر از 120 پزشک قانونی که مورد سوال قرار گرفتند به سوالات پاسخ دادند. میانگین سنی شرکت کنندگان 0/ 5+6/ 36 سال و میانگین سابقه کاری 3/9+ 5/6 آنان سال بود. 59 نفر (6/ 59%) از پاسخ دهندگان مرد و 40 نفر (6/ 40%) زن بودند. نقطه نظرات تمام پاسخ گویان در مورد 7 سوال (3/11% موارد) کاملا« یکسان بود. نظرات کارشناسی پاسخ گویان در 41 مورد کارشناسی (1/ 66% موارد) اختلاف خفیف (99-75% تشابه با یکدیگر) داشت، در 13 مورد از سوالات (0/ 21% موارد) اختلاف متوسط (74-50% تشابه) و در مورد یک سوال کارشناسی (6/ 1% موارد) نیز اختلاف نظر شدید (کمتر از 50% تطابق با یکدیگر) وجود داشت.
نتیجه گیری: اگرچه عمده موارد عدم وحدت رویه در این پژوهش در محدوده اختلاف نظر خفیف قرار دارد ولی با توجه به نقش و اهمیت فراوان نظریات کارشناسی پزشکان قانونی در آرای محاکم قضایی و به تبع آن تاثیر به سزای این آرا در حقوق طرفین دعوی، ایجاد وحدت رویه مطلوب تر میان کارشناسان پزشکی قانونی ضرورت دارد.
Background & Aim: In order to respect patients rights who are referred to Legal Medicine Organization، comprehensive and precise laws & regulations are needed to make uniform expertise views and consequently uniform judgments by court at different times and places. We studied the extent of uniformity in expertise views given by legal medicine experts of Tehran and their assessments of Arsh and Dieh in some selected cases، to find their degree of uniformity.
Materials & Methods: This study is a prospective research which uses a piloted anonymous questionnaire; by open and closed questions، it includes selected cases for assessing Arsh and Dieh. Findings: The study population was comprised of 99 legal medicine physicians working in Tehran’s province legal medicine center from a roster of 120. The average age was 36.6 ± 5.0 years، and the mean of working experience was 5.6 ±3.9 years. 59 were men (59.6%) and 40 were women (40.6%) all of the responders believed in identical answers in 7 of 62 (11.3%) questions and there was no controversy. There was a mild controversy (75-99% similarity in answers) over 41 (66.1%) questions and a moderate controversy (50-74% similarity in answers) over 13 (21.0%) questions. Only over one (1.6%) question، there was a severe controversy (less than 50% similarity in answers).
Conclusion: Although the main differences cause mild controversies، the important role of forensic medicine expertise views in judgments of court and consequently the patient’s rights necessitates a higher quality and uniformity of forensic medicine prescriptions.
