چکیده:
اگرچه انگلیس و امریکا هر دو از سیستم کامنلا پیروی میکنند و از جنبۀ نظری دارای قواعد حقوقی مشابهی در زمینۀ مبنای مسئولیت در حملونقل هستند، بهنظر میرسد کشورهای تابع کامنلا با توجه به شرایط و اوضاع و احوال کشور خود، برخی قواعد مسئولیت را جرح و تعدیل کردهاند. در بررسی انجامشده، این دو کشور در خصوص درج شرایط معافیت، مبنای مسئولیت یا تعهدات متصدی حملونقل عدول کردهاند. نویسنده در این مقاله درصدد اثبات این فرضیه است که سیستم کامنلا انعطافپذیر است و دولتهای پیرو این سیستم، در برخی موارد از اصول نظری مسئولیت فاصله میگیرند و بهدلیل شرایط کشور متبوع خود، از قواعد تعدیلیافته پیروی میکنند.
