چکیده:
بنابر گزارشهای تاریخی، چندهمسری در فرهنگها و سرزمینهای گوناگون، پیش و پس از اسلام رواج داشته است. قرآن کریم نخستین خانواده را حاصل ازدواج یک مرد با یک زن میشمرد. آیه سوم سوره نساء، در آنصورتکه بیم رود دادگری میان یتیمان رعایت نشود، ازدواج یک مرد با حداکثر چهار زنرا روا میشمرد. مفسران در بیان ارتباط این شرط (بیم از بیداد بر یتیمان) و جزا (جواز چندهمسری) سخنان گوناگون گفتهاند. به هر روی، وجود خانوادههای بیسرپرست، دختران یتیم و زنان بیوه، زمینه و حکمت چندهمسری است و رعایت عدالت میان همسران شرط این حکم است. آمار مرگومیر ناشی از جنگ، قتل عمد، تلفات جادهای، و بیماریهای سخت در سطح ملّی و جهانی همه نشانگر آن استکه مرگ در مردان، به ویژه در سنین جوانی و میانسالی بیشتر از زنان روی میدهد. این مساله، موجب بر هم خوردن تناسب جنسیتی در جوامع بشری میشود، به گونهای که در برابر هر مرد در سنّ ازداوج بیش از یکزن قرار میگیرد. ارتباط میان شرط و جزای موجود در آیه سوم سوره نساء و آمارهای موجود نشاندهنده این واقعیت استکه چندهمسری نه از سر هوسرانی یا تعددطلبی، بلکه به مثابه یک ضرورت اجتماعی و برای تامین نیازهای زنان بیوه و دختران یتیم در جوامع بشری شکل گرفته و در شریعت اسلامی روا دانسته شده است. از اینرو، چندهمسری در این چارچوب و با رعایت شروط عدالت، معاشرت متعارف، تامین هزینههای زندگی همسران و نامشروع بودن روابط تعلیقی، حکمی موّجه و قابل دفاع است.
According to historical reports, polygamy was prevalent in different cultures and lands before and after Islam. The Holy Qur'an describes the first family as the result of a man's marriage to a woman. The third verse of chapter Nisa, if there is fear about lack of justice among the orphans, permits the marriage of a man with a maximum of four women. Interpreters have made various statements regarding the relationship between this condition (fear about lack of justice for orphans) and (permission of polygamy). However, the existence of headless families; orphan girls and widows is the field and wisdom of polygamy, and justice for spouses is a condition of this verdict. The statistics of death emergent from war, deliberate homicide, road fatalities, and serious illnesses at national and global levels all indicate that deaths occur more frequently in men, especially in young and middle-aged women. This issue disrupts gender equality in human societies, so there is more than one woman toward each man in the age of marriage. The relationship between the condition and result contained in the third verse of Surah Al-Nisa and the existing statistics reflects the fact that polygamy was formed not out of sensuality or pluralism, but as a social necessity to answer the needs of widows and orphaned girls in human societies and in the Shari'a. Islam is considered valid. Therefore, polygamy in this context and in the light of the conditions of justice, the standard of living, the cost of living for spouses, and the illegality of suspended relationships is justifiable and defensible.
