چکیده:
قانونگذار گاهی، تنها راهحل اختلاف برخی از موضوعات را داوری دانسته و سبب شکلگیری داوری اجباری در نظام حقوقی شده است.لذا داوری یا اختیاری است که منشأ قراردادی دارد و یا اجباری است که منشأ قانونی دارد. در داوری اجباری، طرفین در ارجاع یا عدم ارجاع اختلاف به داوران، اختیار و ارادهای ندارند و قانون آن ها را ملزم می کند که به داوری مراجعه نمایند. داوری اجباری، بههیچوجه منافی حق دادخواهی به شمار نمیرود، چراکه سلب حق دادخواهی هنگامی صادق است که هیچ مرجع تظلم خواهی وجود نداشته باشد. از طرفی، دادخواهی صرفاً به معنای مراجعه به دادگاههای دولتی نبوده و مراجعه به داوری نیز تکافوی حق دادخواهی را می نماید. از مصادیقی که روند داوری اجباری در آن جریان دارد میتوان به اختلافات بازار اوراق بهادار، پیشفروش ساختمان، خصوصیسازی، قراردادهای پیمانکاری و اختلافات خانوادگی اشاره کرد. در این پژوهش، با روش توصیفی تحلیلی می توان برشمرد که هرچند داوری اختیاری اصل و داوری اجباری استثناء است، اما جهت جلوگیری از اطاله دادرسی،کاهش پرونده های قضایی، سرعت بیشتر در رسیدگی به اختلافات و...ساز و کار نهاد داوری اجباری مفید ارزیابی می گردد.
The legislator sometimes considers the only solution to some of the issues being arbitrary and has led to the formation of compulsory arbitration in Iran's legal system. Therefore, arbitration or Optional is the source of the contract, or compulsory, which has legal origin. In compulsory arbitration, the parties have no discretion in referring or refusing a dispute to arbitrators, and the law requires them to refer to arbitration. Compulsory arbitration is not in any way a right to litigation, because foreclosure is true when there is no prosecution. On the other hand, litigation simply does not mean referring to state courts and referring to arbitration also provides for the right to litigation. Examples of the process of compulsory arbitration include securities market disputes, pre-sale construction, privatization, contracting, and family disputes.
