چکیده:
در حقوق داخلی به آسیبهایی که جرم قتل عمدی به خانواده بزه دیده وارد میآورد، توجه خاصی نشده است و بزهکار یا جامعه تعهدی نسبت به بازماندگان مقتول ندارند. این در حالی است که از دست دادن عضوی از خانواده اعضای دیگر را با بحرانهای گوناگون مواجه کرده و زمینه بروز مشکلات متعدد را در خانواده و جامعه فراهم مینماید به ویژه اگر عضو از دست رفته سرپرست خانواده باشد. در این مقاله نتیجهگیری میشود که جرم قتل عمدی علاوه بر بزه دیده مستقیم، دارای بزه دیده غیر مستقیم (مانند اولیاء دم و افراد تحت تکفل مقتول) نیز میباشد که در گام اول باید توسط اجتماع به رسمیت شناخته شوند و در گام بعدی مورد حمایتهای لازم از سوی قانونگذار و جامعه حقوقی قرار گیرند. در این راستا با بررسی حقوق داخلی مشخص میشود که تعریف بزه دیده شامل بستگان و افراد تحت تکفل مقتول میباشد و براساس مبانی مختلف از جمله قانونی، شرعی و منطقی باید از آنها هم حمایت نمود در اسناد بین المللی مختلف نیز صراحتا از عنوان بزه دیده بر بازماندگان مقتول استفاده شده و کشورهای عضو ملزم به حمایت از این گروه از بزه دیدگان شدهاند.

In this way , it is clear from the examination of domestic law that the definition of victim includes relatives and victims of the victim and on the basis of various legal, religious and rational principles, it should be supported in various international documents as well. Victim survivors have been used and member states have been required to support this group of victims.
