چکیده:
از مهمترین انواع قاچاقها که موجب افزایش جرایم اقتصادی میگردد، قاچاق کالا و ارز است. قاچاق کالا از ابعاد مختلف اقتصادی، اجتماعی، سیاسی و فرهنگی در حقوق داخلی و بینالمللی قابل بررسی است. هدف پژوهش حاضر تحلیل وضعیت قاچاق کالا از منظر حقوق بینالملل اقتصادی با تاکید بر وضعیت حقوقی ایران است. در قانون مبارزه با قاچاق کالا و ارز 1392 و همچنین کنوانسیونهای نایروبی، سازمان ملل متحد و سازمان تجارت جهانی به تعریف قاچاق کالا و ارز و ابعاد مختلف آن پرداخته شده است. از آثار مخرب و زیانبار قاچاق کالا بر توسعه پایدار میتوان به کاهش اشتغال، افزایش جرایم اقتصادی، تهاجم فرهنگی، فساد اداری، فاصله طبقاتی جامعه و... اشاره کرد. جهت جلوگیری از اینگونه آثار زیانبار میتوان با تصویب قوانین جدید یا اصلاح قوانین گذشته، نظارتهای قضایی داخلی و بینالمللی قدم موثری برداشت و از طریق نظارتهای اقتصادی و کنترل مرزها از قاچاق کالا در کشور جلوگیری نمود.
One of the most important kinds of smuggling that increases economic crime is the smuggling of goods and currency. Smuggling of goods can be investigated from various economic, social, political, and cultural dimensions by considering domestic and international law. The purpose of this study is to analyze the status of goods smuggling from the perspective of international economic law with an emphasis on the legal status of Iran. The Anti-Trafficking in Goods and Foreign Exchange Law the Nairobi Conventions, the United Nations, and the World Trade Organization, define the smuggling of goods and currency and its various dimensions. The destructive and harmful effects of smuggling on sustainable development include declining employment, increasing economic crime, cultural aggression, corruption, the class gap in society. To prevent such harmful effects, effective domestic and international judicial oversight can be taken by passing new laws or amending past ones. It prevented the smuggling of goods into the country through economic supervision and border control.
