چکیده:
تعلیم و تربیت از ضروریترین نیازهای جامعه است که موجب پیشرفت آن جامعه از لحاظ نیازهای مادی و معنوی میشود. حق بر تعلیم و تربیت، همواره از مهمترین دغدغههای حقوق بشری بوده و در مبانی دینی و اسناد حقوقی مورد توجه قرار گرفته است. نوشتار پیشِرو، با روش توصیفی _ تحلیلی و با هدف تبیین نظریههای مطرح در حوزه ادله حق بر تعلیم و تربیت و اثبات جایگاه مهم دو نهاد خانواده و حکومت، و حقِ تکلیفی بر متربی و به دنبال پاسخ برای این پرسش است که مبانی و ادله حق بر تعلیم و تربیت از منظر فقه چیست و این حق چگونه در حقوق اساسی جمهوری اسلامی ایران منعکس شده است. در این راستا، منابع اسلامی، اسناد حقوقی و نظرات اندیشمندان عرصه تعلیم و تربیت، واکاوی و ادله حق بر تعلیم و تربیت مورد بررسی قرار گرفته است. یافتهها نشان میدهد که هیچ ادلهای به صورت قاطع و بدون اثرگذاری دیگری (خانواده و حکومت) نسبت به حق بر تعلیم و تربیت وجود ندارد و این دو لازم و ملزوم یکدیگرند. تعلیم و تربیت برحسب اهداف آموزش و پرورش، مسئولیت مشترک والدین و دولت است. همچنین تعلیم و تربیت افراد جامعه، حق تکلیفی فرد است که بر متعلم نیز واجب و تکلفی است در شکوفایی استعداهایش کوتاهی ننماید و این فرایند، باید به صورت مشترک توسط فرد، حکومت و نهاد خانواده صورت گیرد.
Education is one of the most essential needs of society, which leads to the development of that society in terms of material and spiritual needs. The right to education has always been one of the most important human rights concerns and has been considered in religious principles and legal documents. The present article, with a descriptive-analytical method and with the aim of explaining the theories in the field of evidence of the right to education and proving the important position of the two institutions of family and government, and the duty of the educator and seeks answers to the question What is education from the perspective of jurisprudence and how is this right reflected in the constitutional rights of the Islamic Republic of Iran? In this regard, Islamic sources, legal documents and opinions of thinkers in the field of education, analysis and arguments of the right to education have been examined. The findings show that there is no conclusive evidence without any other influence (family and government) on the right to education and these two are necessary for each other. Education, according to the goals of education, is the joint responsibility of parents and the government. Also, the education of the people of the society is the duty of the individual, which is also obligatory and obligatory on the learner not to fail in the flourishing of his talents, and this process must be done jointly by the individual, the government and the family institution.
