چکیده:
هدف: امکان تغییر نحوه اجرای قصاص، یکی از مباحث مهم در حوزه فقه جزائی است.
مواد و روش ها: در مورد تغییر روش اجرای قصاص، دو موضوع قابل طرح است؛ استیفای قصاص با استفاده از روشها و ابزارهای جدید و حکم استفاده از داروهای بیحس و بیهوش کننده به هنگام اجرای قصاص. درباره به کارگیری روشها و ابزارهای جدید در قصاص، دو دیدگاه وجود دارد که به نظر میرسد دیدگاه راجح، قول آن دسته از فقیهانی است که میگویند بهکارگیری ابزارها و روشهای نوینی که آسانتر از شمشیر، ازهاق روح را حاصل میکنند شرعاً واجب است و حکّام اسلامی باید در جریان قصاصِ جانیان آن را به کار بگیرند. همچنین درباره جواز استفاده از داروهای بیهوش و بیحسکننده به هنگام استیفای قصاص به نظر میرسد بهترین دیدگاه، اناطه جواز بهکارگیری این داروها به اذن و رضای مستحقِ قصاص (اعم از ولی دم یا مجنیعلیه) است.
یافته ها: این دیدگاه همخوانی بیشتری با ادلّه شرعی و روح شریعت دارد و بیش از سایر دیدگاهها با مقاصد تشریع قصاص سازگار است.
نتیجه گیری: نتایج این تحقیق نشان از آن است که این مسأله به صورت کلّی، قابلیت طرح را دارد و فقها ابعاد مختلف آن را تبیین کردهاند. نکته بسیار مهم در مورد این مسأله آنکه مصادیق آن مستحدث هستند و تنها در عصر اخیر و با تغییرات و پیشرفتهای علمی حاصلشده طرح شده اند.
Purpose: The possibility of changing the manner of retribution is one of the important issues in the field of criminal jurisprudence.
Materials and Methods: There are two issues that can be raised regarding the change of the method of retribution; Execution of retribution using new methods and tools and the order to use anesthetics and anesthetics during retribution. Regarding the use of new methods and tools in retaliation, there are two views that seem to be the preferred view, according to those jurists who say that the use of new tools and methods that make the soul easier than the sword is legally obligatory, and Islamic rulers They should use it during the retribution of criminals. Also, it seems that the best view regarding the permission to use anesthetics and anesthetics when retribution is used is to allow the use of these drugs with the permission and consent of the person deserving of retribution (whether the guardian or the victim).
Findings: This view is more in line with the Shari'a arguments and the spirit of Shari'a and is more compatible with the purposes of retribution legislation than other views.
Conclusion: The results of this study show that this issue can be proposed in general and jurists have explained its various dimensions. A very important point about this issue is that its examples are new and have been proposed only in the recent era and with the changes and scientific advances that have been achieved.
