چکیده:
چکیده: شیوع ویروس کرونا بحرانی بین المللی است که در طول یکصدسال گذشته بی سابقه بوده است. این ویروس برای نخستین بار در ووهان چین در اوایل دسامبر 2019 گزارش گردید و دامنه آن به تدریج،کل جهان را درنوردید. در چنین شرایطی، کارآمدی حقوق بین الملل در حفظ جان آدمیان و ارتقاء حق بر سلامت به محکِ آزمونی سخت گذاشته شده است. مهمتر آنکه، به تعبیر کمیسر عالی حقوق بشر سازمان ملل متحد (میشل باشله)، کرونا به معیاری برای آزمون جامعه بین المللی بدل گردیده است. مقاله حاضر نحوه مواجه حقوق بین الملل با بحران ناشی از کرونا را در سه عرصه مختلف تحلیل خواهد نمود: در وهله نخست، سهم سازمان جهانی سلامت (بهداشت) درمقام مسئول اصلی حفظ سلامت آدمیان در مقابله با شیوع ویروس کرونا تحلیل خواهد شد. در وهله دوم، مسئولیت بین المللی دولت ها در تضمین حق بر سلامت به منظور تعیین میزان کارآمدی حقوق بین الملل سنجیده خواهد شد. در وهله سوم، تعلیق حق های بشری به علت وضعیت اضطراری ناشی از شیوع کرونا در محک آزمون نظام بین المللی حقوق بشر قرار خواهد گرفت. در هریک از سه عرصه پیش گفته، پرسش آن است که ساختار وستفالیایی حقوق بین الملل تا چه حد برای مقابله با بحران های بین المللی و حفظ کرامت آدمیان کارآمد است. کلید واژه ها: کرونا، کارآمدی حقوق بین الملل، سازمان جهانی سلامت، مسئولیت بین المللی دولت ها، وضعیت اضطراری
Abstract: The outbreak of coronavirus is an international crisis which is unprecedented in the contemporary world. For the first time, this lethal disease was reported in china in the beginning of December 2019 and spread gradually all over the world. In the current situation, the efficiency of international law in protecting the lives of human beings as well as promoting the right to health is criticized by scholars. Importantly, in the view of the UN high commissioner for Human Rights (Michelle Bachelet), coronavirus is a criterion for testing international community in terms of guarantying Human security. The present article will analyze the reaction of international law to this crisis in three aspects: firstly, the role of WHO in reaction to this widespread disease will be analyzed. Secondly, the international responsibility of States to ensure the right to health will be surveyed. Thirdly, derogations during a state of emergency arising from the outbreak of coronavirus will be examined. In each of the afore-mentioned questions, our analysis will be focused on the efficiency of Westphalia structure of international law for coping with international crisis as well as protecting Human security. پرسـش ايـن است که آيا دولت ها به سبب شيوع بيماري هاي فراگير مي توانند ورود و خروج مسافران را محدود نمايند؟ در اين مورد، مادة ٣١ مقررات جهاني سـلامت تصـريح نمـوده اسـت کـه علـي الاصـول دولت ها نمي توانند ورود و خروج مسافران را محدود نمايند؛ مگر آنکـه مخـاطره اي جـدي وجـود داشته باشد که سلامت عمومي را تهديد نمايد.
با اين توصيف ، پرسش اساسي ديگر آن است که آيا دولت ها را مي توان در زمينة شيوع فراگير اين بيماري به لحاظ بين المللي مسئول دانست ؟ ابتدا بايد روشـن نمـود کـه در ايـن زمينـه بايـد موضوع مطابق با طرح مسئوليت بين المللي دولت ها مصوب سال ٢٠٠١ که حاوي قواعـد ثانويـة حقوق بين الملل است ، به مثابه کتابچة راهنماي مسئوليت دولت ها و همچنـين بـه نظـام حقـوق بين الملل سلامت و به طور مشخص اساسنامة سازمان جهاني سلامت و ساير اسـناد بـين المللـي حقوق بشري ، به عنوان قواعد اوليه مورد بررسي قرار گيرد.
