چکیده:
موضوع و هدف پژوهش: هدف پژوهش حاضر، بررسی وضعیت قوانین مصوب در حوزه مالی در ایران از حیث سه ویژگی؛ شفافیت (عدم ابهام)، ثبات (عدم اصلاح مکرر) و عدم پراکندگی می باشد.روش پژوهش: پژوهش حاضر از جهت هدف؛ کاربردی، از جهت شیوه تجزیه و تحلیل، روش انجام و ارائه نتایج پژوهش؛ از نوع تحلیل محتوایی (توصیفی) و از جهت نوع پژوهش، کیفی محسوب می گردد. جامعه آماری پژوهش نیز شامل کلیه قوانین مصوب در حوزه مالی، از زمان تشکیل مجلس اول لغایت پایان مجلس دهم می باشد. یافته های پژوهش: بر اساس اطلاعات و تحلیل های آماری احصاء شده، وضعیت قوانین مصوب در حوزه مالی در ایران از حیث شفافیت، ثبات و عدم پراکندگی، مطلوب ارزیابی نمی گردد که این نتیجه گیری، منطبق با پژوشهای پیشین نیز می باشد.نتیجه گیری، اصالت و افزوده آن به دانش: نتایج این پژوهش نشان می دهد که 10 درصد از کل قوانین مصوب در حوزه مالی، در قالب قوانین تفسیری (در جهت رفع ابهام موجود در قوانین)، 45 درصد، در قالب قوانین اصلاحی (که این نسبت موید بی ثباتی قوانینِ حوزه مالی می باشد)، 2درصد در قالب تمدیدِ قوانین آزمایشی و صرفاً 43 درصد در قالب قوانین جدید بوده است. این نسبتها موید ضروری بودن انجام اقدامات اصلاحیِ اساسی در نظام قانونگذاری (از جمله؛ تقویت فرآیند تهیه پیش نویس قانون، رعایت و عنایت ویژه به تدوین و تنقیح قوانین موجود و تغییر نظام قانونگذاری به "لایحه – بنیان") می باشد.
Subject and purpose of research : The purpose of this study is to investigate the status of approved laws in the field of finance in Iran in terms of three characteristics; Transparency (no ambiguity), stability (no frequent correction) and no scatter.Research Method : The present study in terms of purpose; Applied, in terms of analysis method and method of conducting and presenting research results; From the type of content analysis (descriptive) and from the type of research; It is considered qualitative. The statistical population of the study also includes all approved laws in the field of finance, from the time of the formation of the first parliament until the end of the tenth parliament.Conclusion, originality and its addition to knowledge: The results of this study show that Ten percent of all approved laws in the field of finance, in the form of interpretive laws (in order to remove the ambiguity in the laws), Forty-five percent, in the form of amending laws (which confirms the instability of financial laws Two percent was in the form of extension of the experimental rules and only Forty-three percent in the form of the new rules. These ratios confirm the necessity of carrying out fundamental corrective actions in the legislative system (including: strengthening the process of drafting the law, observing and paying special attention to drafting and revising the existing laws, and changing the legislative system to "bill-based").
