چکیده:
جرت فی لیبیا بتاریخ 20 فبرایر 2014 انتخابات الهیأة التأسیسیة لصیاغة مشروع الدستور وفق أحکام الإعلان الدستوری المؤقت الصادر بتاریخ 2 أغسطس 2011 وتعدیلاته, وباشرت الهیأة التأسیسیة أعمالها فی 24 إبریل 2014, وکان من المقرر وفق أحکام الإعلان الدستوری, أن تنتهی الأخیرة من مهامها فی صیاغة مشروع الدستور خلال أجل لا تتجاوز مائة وعشرین یوما من تاریخ انعقاد اجتماعها الأول , غیر أن الهیأة لم تنتهِّ من صیاغة المشروع إلا بتاریخ 29 یولیو 2017, ومن هنا, فإن الاشکالیة القانونیة تعالجها الدراسة تنصب علی تقییم مشروع الدستور المقدم من طرفها فی ضوء المعاییر الدولیة للدیمقراطیة دون البحث فی مدی
دستوریة العمل المنجز.
وخلصت الدراسة إلی أن مشروع الدستور اللیبی لعام 9102 عمل قدر الامکان علی تحقیق أکبر قدر من المواءمة مع المعاییر الدولیة للدیمقراطیة, علی نحو یمکن معه القول بأن هذا مشروع الدستور لعام 2017 یصلح لأن یکون خیارا ینهی الأزمة السیاسیة الحاصلة فی لیبیا منذ العام 2011 لو صدقت النوایا وتم تجاوز المصالح الشخصیة الضیقة والعصبیة الجهویة والمناطقیة والأیدولوجیة.
The constitutional body elections to draft constitution were held in Libya on 20 February 2014 in accordance with the
provisions of the Interim Constitutional Declaration of 2 August 2011 and its amendments. The constituent body began its
work on April 24, 2014. In accordance with the Constitutional Declaration, the latter was scheduled to complete its tasks in
drafting the draft constitution within a maximum of 120 days after the first meeting. However, the Commission had completed
the draft until July 29, 2017. The legal problematic study was therefore to assess the draft constitution submitted by it in the
light of international standards of democracy without examining the constitutionality of the work done.
The study concluded that the 2017 Libyan Constitution draft was as far as possible to achieve the greatest possible conformity
with international standards of democracy, in a way that this draft constitution of 2017 could be said to be an option to end
the political crisis in Libya since 2011 if intentions were ratified and narrow, neurological, regional and ideological interests
were overcome.
