چکیده:
داوری متداولترین شیوهی حلوفصل اختلافات در حوزه تجارت بینالملل بوده و عبارت است از رفع اختلاف فی مابین اصحاب دعوی از طریق واگذاری آن به حکمیت اشخاصی که طرفین دعوی آنها را به توافق خود انتخاب میکنند و شامل دو مرحله رسیدگی به اختلاف و شناسایی و اجرای رأی میباشد. اما این هدف وقتی کامل تر میگردد که رای معتبر بوده و قابلیت اجرایی داشته باشد برای این منظور رأی صادره از سوی مرجع داوری تجاری بینالمللی پس از صدور، نیازمند این است که توسط مرجع اجرا کننده به رسمیت شناخته شود و به اجرا درآید. در این میان موانعی بر سر راه اجرای رأی وجود دارند که معیار نظم عمومی کلیترین و برجستهترین آنها است، چرا که معمولاً محکوم علیه رای داوری با کمک نظم عمومی و با توسل به موجبات و موانعی که مورد حمایت قانونگذار و اسناد و کنوانسیونهای بینالمللی است تلاش مینماید تا از شناسایی و اجرای رای خودداری نماید. نظم عمومی بینالمللی نمایانگر مجموعه سازمانها و قواعد حقوقی است که با مبانی و اصول تمدنی یک کشور ارتباطی ناگسستنی دارند و ناگزیر بر قوانین خارجی مقدم میشوند. این نظم یک نظم مشترک بین کلیه کشورها نیست، بلکه نقطه تعادل بین منافع و نظم عمومی یک کشور با نظم عمومی و منافع دیگر ملتها و نیازهای تجارت بینالملل است. در رابطه با این که نظم عمومی در اجرای احکام داوری تجاری بینالمللی از چه جایگاهی برخوردار است؟ میان جلوگیری از نقض ارزشها و قوانین داخلی و تمایل به احترام نسبت به قطعیت احکام داوری بینالمللی تعارض رخ میدهد که مناسبترین راهکار رفع این تعارض، اعمال مفهوم مضیق نظم عمومی در این زمینه میباشد. البته دادگاه محل اجرای حکم در هر صورت در رابطه با اجرای احکام بینالمللی، بایستی نظم عمومی بینالمللی را اعمال کند و حتی یکسان بودن مقر داوری بینالمللی با دادگاه اجرایی نمیتواند دلیل مناسبی برای اعمال نظم عمومی داخلی دادگاه اجرایی در این زمینه باشد. با این وجود و علیرغم جایگاه و اهمیت نظم عمومی در اجرای احکام داوری تجاری بینالمللی، تمامی ملاحظات مربوط به نظم عمومی کشورها در اجرای احکام داوریهای تجاری بینالمللی قابل اعمال نبوده و صرفاً نظم عمومی بینالمللی کشور مربوطه و با تفسیر مضیق اعمال میگردد.

International public order represents a set of organizations and legal rules that are inextricably linked with the foundations and principles of civilization of a country and inevitably take precedence over foreign laws. This order is not a common order among all countries, but it is a point of balance between the interests and general order of a country with the general order and interests of other nations and the needs of international trade. What is the position of public order in the implementation of international commercial arbitration rulings? There is a conflict between preventing the violation of domestic values and laws and the desire to respect the certainty of international arbitration rulings, and the most suitable solution to resolve this conflict is to apply the narrow concept of public order in this field. Of course, the court where the judgment is executed must apply the international public order in any case in relation to the execution of international judgments, and even the same seat of international arbitration as the executive court cannot be a good reason to apply the internal public order of the executive court in this field. Nevertheless, despite the importance of public order in the implementation of international commercial arbitration awards, all considerations related to the public order of countries cannot be applied in the implementation of international commercial arbitration awards, and only the international public order of the relevant country is applied with a narrow interpretation.
