بدون شک تحت تأثیرسایر تحولات حادث شده در حقوق کیفری، نهاد میانجیگری که شکل بارزی از عدالت ترمیمی میباشد به دنبال سازماندهی شدن و قانونمند شدن است. در جوامع سنتی موضوعات میانجیگری به صورت عرفی بین مردم رواج داشته است اما جامعه امروزی نیازمند شیوه های نوین از میانجیگری است. ایجاد زندگی در کلان شهرها، با فرهنگهای مختلف باعث شکل گیری میانجیگران و ایجاد سازوکارهای گسترده برای آموزش آنان شده است. سیاست جنایی ایران با الگوی سیاست جنایی مشارکتی سعی در گسترش مشارکت مردم و بسط دادن نهاد میانجیگران در دعاون کیفری داشته است. اما آیا با نفوذ میانجیگری کیفری در میان کتابها و قوانین و ساختارمند شدن آن از ظرفیت این نهاد به طور مناسب و به جا در حل و فصل دعاوی استفاده شده است . بدون شک تحت تأثیرسایر تحولات حادث شده در حقوق کیفری، نهاد میانجیگری که شکل بارزی از عدالت ترمیمی میباشد به دنبال سازماندهی شدن و قانونمند شدن است. در جوامع سنتی موضوعات میانجیگری به صورت عرفی بین مردم رواج داشته است اما جامعه امروزی نیازمند شیوه های نوین از میانجیگری است. ایجاد زندگی در کلان شهرها، با فرهنگهای مختلف باعث شکل گیری میانجیگران و ایجاد سازوکارهای گسترده برای آموزش آنان شده است. سیاست جنایی ایران با الگوی سیاست جنایی مشارکتی سعی در گسترش مشارکت مردم و بسط دادن نهاد میانجیگران در دعاون کیفری داشته است.
