چکیده:
مهاجرت دارای پیامدهای مختلف اقتصادی، اجتماعی، فرهنگی، سیاسی و امنیتی میباشد که در نظام حقوق بینالملل و کنوانسیونهای بینالمللی به آن پرداختهشده است. به دلیل عبور و مرور مهاجران و زمینه جرایم تروریستی در مناطق مرزی ایران، ارتباط بین مهاجرت و تروریسم را بیشازپیش تقویت شده است. هدف پژوهش بررسی ملاحظات حقوق بینالملل مبنی بر ارتباط مهاجرت و تروریسم و الزامات پلیسی ناشی از آن در تأمین امنیت مرزی ایران است. پژوهش حاضر ازنظر هدف کاربردی و ازنظر روش، توصیفی – تحلیلی انجامشده است. یافتههای پژوهش حاکی از آن است که الزامات پلیسی جمهوری اسلامی ایران در تأمین امنیت مرزی برای مقابله با جرایم تروریستی ناشی از مهاجرت، بهطور عمده بر محور تدابیر و سازوکارهای کنترلی، اقدامات مقابلهای-انتظامی، اطلاعاتی و اشراف اطلاعاتی بر مهاجران متکی است. از طرفی از منظر حقوق بینالملل نیز سیاستهای سختگیرانه و محدودکنندهتری نسبت به مهاجرت و پیامدهای ناشی از آن اتخاذ گردیده است. پس از حادثه 11 سپتامبر 2001 و سایر حوادث مشابه، سیاستگذاریهای بینالمللی از سوی اتحادیه اروپا مبنی بر پیوندهای بین مهاجرت و تروریسم این مهم را تقویت کرده است. نتایج تحقیق نشان میدهد که در کنار دستاوردهای بینالمللی و رویکرد حقوق بینالملل مبنی بر پیوندهای اساسی بین جرایم تروریستی ناشی از مهاجرت، الزامات و سازوکارهای پلیسی و امنیتی لازمالاجرا برای پیشگیری از آن ضروری به نظر میرسد، بر این اساس، سیاستگذاریهای لازم در تأمین امنیت مرزی بر محور تدابیر کنترلی، مقابلهای و اطلاعاتی صورتبندی شده و نیازمند همکاری مشترک پلیسهای تخصصی و دستگاههای اجرایی متولی در این زمینه است.
Immigration has various economic, social, cultural, political and security cons-equences that are addressed in the international legal system and international conventions. Due to the passage of immigrants and the context of terrorist crimes in the border areas of Iran, the link between immigration and terrorism has been further strengthened. The purpose of this study is to examine the considerations of international law regarding the relationship between immigration and terrorism and the resulting police requirements in ensuring Iran's border security. In terms of its objectives the present study is of an applied research type and in terms of methodology it is considered as a descriptive-analytical study. Findings indicate that the police requirements of the Islamic Republic of Iran in providing border security to deal with terrorist crimes caused by immigration are mainly based on measures and control mechanisms, counter-disciplinary measures, intelligence and intelligence dominance on immigrants. International law has also adopted stricter and more restrictive policies on immigration and its consequences. The aftermath of 9/11 and other similar events have reinforced the EU's international policy on the links between immigration and terrorism. The results of the study show that in addition to the international achievements and the international law approach based on the basic links between terrorist crimes resulting from immigration, the police necessities and security requirements and mechanisms to prevent it, seem to be the necessary. Accordingly, the required policies to ensure border security are formulated on the basis of control measures, confrontations and information, and require the joint cooperation of specialized police and executive bodies in charge in this field.
