چکیده:
اصل ابتکار عمل اصحاب دعوای مدنی، یکی از اصول راهبردی دادرسی مدنی است. براساس این اصل، آن چه در شکل گیری، استمرار و اختمام فرایند دادرسی مدنی نقش نخست را ایفاء میکند ارادهی اصحاب دعوا است. در خصوص مبانی این اصل بین حقوقدانان اختلاف نظر است. برابر نظریهی اتهامی بودن دادرسی، دعوا شیء متعلق به طرفین آن است و دادرس بدون آنکه در کشف حقیقت امر، آن چنان که هست مشارکتی داشته باشد به واقعیتی تشریفاتی اکتفا مینماید و وجدان او صرفاٌ با اتکا به آن چه طرفین با ابراز دلیل نزد او اثبات میکنند اقناع میشود. بر مبنای نظریهی عدالت آیینی، دادگاه باید با توجه به دلایل ابراز شده توسط متداعیین، آنچه را صحیح میداند مورد حکم قرار دهد و تصمیم دادگاه باید مستدل و مستند به حکم قانون و مدارک موجود درپرونده و از زاویهی دادرسی عادلانه مورد ارزیابی قرار گیرد. برابر اصل حاکمیت اراده نیز ارادهی اصحاب دعوا در کنترل جنبههای مختلف از دادرسی مدنی: از جمله شروع و ادامهی دادرسی و همکاری میان اصحاب دعوا و دادگاه تجلی می یابد و دادگاه باید با توجه به جنبه هایی از دادرسی مدنی که طرفین تحت اصل حاکمیت اراده کنترل می کنند عمل کند.جایگاه این اصل در حقوق ایران نیز مورد توجه بوده و شواهد عدیدهی قانونی از اقدامات قضایی دادرس با عطف به درخواست های متداعیین قابل ملاحظه است که از زاویهی اتهامی بودن نظام دادرسی ایران که از جمله مبانی توجیه گر اصل است قابل توجیه میباشد.
