چکیده:
تفسیر قضایی یکی از روشهای تفسیر قانون می باشد که مقام قضایی با مداقه در یک ماده قانونی، با استفاده از روش های مختلف اقدام به تفسیر مفاد قانون برای حل و فصل یک دعوا می نماید و به عبارتی برداشتی را برمی گزیند تا هم متن قانون حفظ شود و هم بتوان به نحوی به هدف غایی قانونگذار نیز دست یافت. مقام قضایی در امور حقوقی برای تفسیر یک قانون با محدودیت خاصی مواجه نمی باشد اما زمانیکه بحث قوانین کیفری و متعاقبا مجازات یک فرد مطرح می شود، چارچوب خاصی برای تفسیر بروز و ظهور پیدا می کند. اصل قانونی بودن جرم و مجازات، اصل برائت، تفسیر مضیق قوانین کیفری و تفسیر به نفع متهم مهمترین چارچوب های موجود برای تفسیر قانون است و مقام قضایی بایستی با در نظر گرفتن این اصول اقدام به تفسیر ماده قانونی نماید. اما گاهی مقامات قضایی در استفاده از برخی از این اصول دچار افراط یا اشتباه محاسباتی می شوند به گونه ای که تا با یک قانون ناقص یا مبهم مواجه می شوند بلافاصله به اصل برائت و تفسیر مضیق تمسک جسته و متهم را با برائت مواجه می سازند؛ هرچند این روش در بسیاری از جرایم دارای محاسنی می باشد لکن در برخی از جرایم از جمله جرایم اقتصادی که نگاه قانونگذار سختگیرانه می باشد و به تبع آن وقوع چنین جرایمی در میان مردم ایجاد حساسیت می کند، باید نگاه و روش مقام قضایی نفع جامعه و حفظ حقوق بیت المال را هم در بربگیرد و به گونه ای نباشد که اشخاصی با ارتکاب جرایم اقتصادی و با گریز از خلاهای قانونی، عدالت و رسیدگی قضایی عادلانه را به سخره بگیرند.

In legal affairs, the judicial authority does not face any special limitation for interpreting a law, but when the discussion of criminal laws and subsequently the punishment of a person is raised, a special framework for interpretation emerges. The principle of legality of crime and punishment, the principle of acquittal, the narrow interpretation of criminal laws and the interpretation in favor of the accused are the most important frameworks for interpreting the law, and the judicial authority should interpret the legal article by considering these principles. But sometimes the judicial authorities go to extremes or make miscalculations in the use of some these principles in such a way that when they come across an incomplete or ambiguous law, they immediately cling to the principle of acquittal and narrow interpretation and acquit the accused; Although this method has merits in many crimes, but in some crimes, including economic crimes, where the legislator's view is strict and as a result, the occurrence of such crimes creates sensitivity among the people, the view and method of the judicial authority should be in the interest of the society and It should also include the protection of the rights of the Treasury and not in such a way that people make a mockery justice and fair judicial proceedings committing economic crimes and avoiding legal loopholes.
