چکیده:
یکی از منابع معتبر حقوق بین الملل عمومی قاعدۀ آمرۀ است؛ قاعدهای که توسط مادۀ 53 عهدنامه 1969 وین در خصوص حقوق معاهدات معرفی گردیده که جامعۀ بین المللی دولتها، در کل خود، آن را در حد قاعدهای که هیچ گونه تخطی از حدود آن مجاز نیست و نه میتواند جز با قاعدۀ جدید حقوق بین الملل عام، با همان خصوصیت، تغییر یابد، مورد شناسایی قرار داده است. امروزه دیدگاه مطرح حقوقدانان بر این است که عدۀ از حقهای بشری، به ویژه حقوق بنیادین بشر، نیز جزء قواعد آمرۀ بین المللی شمرده میشوند. حقوق بنیادین بشر، حقوقیاند که مطابق بند 2 مادۀ 4 میثاق بین المللی حقوق مدنی و سیاسی 1966 دولتها تحت هیچ نوع شرایطی نمیتوانند آنها را نقض و یا محدود نمایند. مقاله حاضر با بررسی دیدگاههای مطرح حقوقدانان در خصوص موضوع، ویژگیهای قاعدۀ آمرۀ بین المللی و حقوق بنیادین بشر، واضح ساخته است که قاعدۀ آمرۀ بین المللی، بر خلاف حقوق بنیادین بشر، در مواردی، مانند وضع قاعدۀ آمرۀ جدید توسط جامعۀ بین المللی (دولتها)، تغییر را میپذیرد. پس رابطه در میان این دو نوع قاعده از جنس «عموم و خصوص من وجه» بوده، با در نظرداشت ویژگیهای هرکدام، تبدیل حقوق بنیادین بشر به قواعد آمرۀ بین المللی با ماهیت و ذات حقوق بنیادین بشر منافات دارد. لذا بهتر است بجای قرار دادن حقوق بنیادین بشر در جایگاه قواعد آمرۀ بین المللی، آنها در مقام والای تغییر ناپذیری خودشان در نظر گرفته شوند.
One of the most significant sources of Public International Law is the Peremptory Norms (jus cogens); According to Article 53 of the 1969 Vienna Convention: "the Peremptory Norm of General International Law is a norm accepted and recognized by the International Community of States as a whole as a norm from which no derogation is permitted and which can be modified only by a subsequent norm of General International Law having the same character." Nowadays, the Famous viewpoints of lawyers are that: Fundamental Human Rights became part of the Peremptory Norms of International Law (jus cogens). According to article 4, paragraph 2 of International Covenant on Civil and Political Rights, 1966 (ICCPR), Fundamental Human Rights are those rights, under any circumstances, States cannot violate or restrict them.This article explains the characteristics of both categories (Peremptory Norms of International Law and Fundamental Human Rights Norms) and makes it clear that the Peremptory Norms of International Law are changeable and can be modified by a subsequent norm of General International Law having the same character, contrary to the fundamental human rights. Therefore, the relation between these two categories of norms is kind of "Generality and peculiarity in some respect" Considering the characteristics of both of them, modifying the Fundamental Human Rights into Peremptory Norms are incompatible with the nature and essence of Fundamental Human Rights. Therefore, instead of putting Fundamental Human Rights in the position of Peremptory Norms, it would be better if they were seen as their immutability position.
