چکیده:
شمول جغرافیایی تعهدات حقوق بشری دولتهای متعاهد نسبت به اسناد و معاهدات حقوق بشری اکنون صرفا به عرصه قلمرو تحت حاکمیت آنها محدود نمیگردد؛ بلکه به نظر میرسد با خروج از آن حیطه، سیر تکامل را میپیماید به طوری که دولتهای متعاهد را در حوزه جغرافیایی گسترده تری ملتزم به رعایت حقوق و آزادیهای مندرج در این اسناد میکنند. با شکلگیری شورای حقوق بشر و مطرح شدن مساله ((عدالت جغرافیایی)) و افزایش گستره تصمیمات این شورا در راستای نظارت بر عدم نقض حقوق بشر توسط دولتها رویههای نظارتی بهتری همچون یو. پی. آر در این شورا شکل گرفت و توانست به پیشرفتهای چشمگیری برسد. سوال اصلی تحقیق حاضر به این صورت است که چه مولفههای جغرافیایی بر رویههای نظارتی گزارشهای شورای حقوق سازمان ملل متحد تاثیرگذار است؟ نتیجه تحقیق حاضر بدین صورت است که مولفههای جغرافیایی هم چون تناسب اعضا با جغرافیای منطقهای اعضاء، تلاش برای عضویت دولتها از یک منطقه جغرافیایی و... از مولفههای جغرافیایی تاثیرگذار بر رویههای نظارتی گزارشهای شورای حقوق بشر ملل متحد است کما اینکه در طول سالهای گذشته، عضویت عربستان سعودی در شورای مزبور موجب عقیم ماندن تلاشها برای محکومیت این کشور در شورای حقوق بشر شد.
The geographical scope of the human rights obligations of the Contracting States to human rights instruments and treaties is now not limited to the territory under their jurisdiction; Rather, it seems to be evolving beyond that area, obliging the Contracting Governments to respect the rights and freedoms set forth in these instruments in a wider geographical area. With the formation of the Human Rights Council and the issue of "geographical justice" and the increase in the scope of the decisions of this council in order to monitor the non-violation of human rights by governments, better regulatory procedures such as UPR were formed in this council and Significant progress has been made. The main question of the present study is what geographical components influence the oversight procedures of the UN Law Council reports? The result of the present study is that geographical components such as the proportion of members to the regional geography of the members, the effort of governments to join a geographical area, etc. are geographical components that affect the monitoring procedures of the reports of the UN Human Rights Council. As in previous years, Saudi Arabia's membership in the council has thwarted efforts to convict it in the Human Rights Council.
