چکیده:
حفاظت از محیط زیست جهانی و نظام توسعه را باید بعنوان یک واحد مشترک در جهان پذیرفت و بر اهمیت و مراقبت ازآن تاکید جدی و همیشگی داشت. مشکلات محیط زیستی مانند آلودگی هوا، گرم شدن کره زمین، قطع درختان برای مقاصد تجاری و شخصی، نازک شدن لایه اوزون، استفاده تعمدی، بیرویه و بیبرنامه از آبهای زیر زمینی و همچنین منقرض کردن گونههای گیاهی و جانوری نادر، از قبیل این مخاطرات میباشند که آشفتگیهای محیطی زیستی را بوجود آوردند و میتواند مسائل اجتماعی، اقتصادی و سیاسی مهمی را برای دولتها ایجاد نمایند. به همین جهت هم اکنون یکی از نگرانیهای اصلی جامعه جهانی، حفاظت از محیط زیست در مقابل اعمال مخرب اشخاص حقوقی مخصوصا دولت هاست زیرا دولتها عامل اصلی آلودگی محیط زیست میباشند. یافتههای این مقاله که با روش تحلیلی-توصیفی و ابزار کتابخانهای به نگارش درآمده است به ما نشان میدهد که در نظام کیفری هر دو کشور در جرایم زیست محیطی نمیتوان دولت را دارای مسئولیت کیفری دانست، اما اشخاص حقوقی را میتوان دارای مسئولیت کیفری دانست.

For this reason, one of the main concerns of the world community is protecting the environment against the destructive actions of legal entities, especially governments, because governments are the main cause of environmental pollution. The findings of this article, which was written with analytical-descriptive methods and library tools, show us that in the criminal system of both countries, the government cannot be held criminally responsible for environmental crimes, but legal entities can be held responsible.
