چکیده:
نظام جزایی برای مقابله با جرم و برخورد با مجرمان طراحی شده است که در هر نظام حقوقی بر اساس نوع رویکرد به جهان و هستی و بهطور خاص انسان، مدلسازی گردیده است برایمثال باور یا عدم باور به آزادی و اختیار انسان اساس بسیاری از مکاتب را تشکیل میدهد؛ نظام جزایی اسلام نیز بهعنوان یکی از اجزاء یا ارکان شریعت و دین مبین اسلام بر اساس نوع نگاه به انسان از طرف آفریدگار هستی طراحی شده است؛ در مقابل در مکاتب دیگر نیز با باور به نوعی انسانشناسی، نظام جزایی و بهطور خاص واکنشها و پاسخهای متناسب به جرم و مجرمان، طراحی و اجراء میشود؛ در این مقاله با روش توصیفی ـ تحلیلی به مبانی انسانشناختی کیفری و در معنای کلیتر حقوق کیفری در جهانبینی توحیدی اسلام و در مقابل برخی از مکاتب حقوقی پرداخته شده است. بهنظر میرسد انسان موجود همیشگی و جاودانهای است که با کوشش و تلاش ارادی و اختیاری خویش، سعادت یا شقاوت خود را رقم میزند؛ البته سعادت و شقاوتی که دنیا و جهان مادی محدود ظرفیت تحقق آ ن را ندارد. در آموزههای دینی، دنیا بهمثابه مزرعه و کشتزار آخرت معرفی شده است. بهلحاظ عینی و کارکردی نیز طبقهبندی بزهکاری به بزهکاری یقه سفیدی و یقه آبی نیز بهدلیل ویژگیهای انسانی هر دسته سیاست کیفری متناسب باید طراحی شود.

On the other hand, in other schools, by believing in a kind of anthropology, the penal system, and in particular, appropriate reactions and responses to crime and criminals, is designed and implemented; In this article, the principles of criminal anthropology and in the general sense of criminal law in the monotheistic worldview of Islam and in contrast to some legal schools have been discussed with a descriptive-analytical method. Man seems to be a perpetual and eternal being who, by his own voluntary effort, determines happiness or misery; Of course, happiness and cruelty that the world and the limited material world do not have the capacity to achieve. In religious teachings, the world is introduced as the farm of the Hereafter.
