چکیده:
زمینه و هدف: نقض مقررات حقوق رقابت و ارتکاب پدیده مجرمانه اخلال در رقابت اقتصادی، لزوم پیش بینی تدابیر واکنشی متناسب قانونی را در قبال آن، آشکار میسازد. هدایت فرآیند صدور حکم و اجرای تدابیر مزبور، نیازمند استقرار نهادهای قانونی است که در اتحادیه اروپا، تابع نظام تعدد مراجع رسیدگی بوده و در حقوق رقابت ایران، از اصل وحدت پیروی میکند.روش: پژوهش حاضر با روش توصیفی و تحلیلی انجام شده است.یافته ها و نتایج: در هر دو نظام سیاست جنایی اتحادیه اروپا و ایران، اِعمال سرکوبگری کیفری، به عنوان آخرین راهکار در زنجیره تدابیر قانونی، منحصراً در صلاحیت محاکم ذیصلاح ملّی است؛ با این تفاوت که در سیاست جنایی تقنینی ایران، نقش آن پررنگتر از اتحادیه اروپا بوده و موجد چالش هایی نیز گردیده است. با وجود اینها، توجّه هر دو نظام سیاست جنایی، به لزوم تنوع در تدابیر واکنشی، در قبال پدیده مجرمانه گفته شده، غیرقابل چشم پوشی بوده و پیشبینی سازوکارهای مبتنی بر سرکوبگری غیرکیفری را موجب شده است.
Field and Aims: Violation of competition law and the commission of the criminal phenomenon of disturbing economic competition reveal the need to provide for appropriate legal response. Leading the process of issuing rulings and implementing these measures requires the establishment of legal institutions that are subject to a system of multiple jurisdictions in the European Union and follow the principle of unity in Iranian competition law.
Method: This is a qualitative and applied research in terms of purpose and in terms of collecting information by documentary method and studying international documents, sources related to the subject and the obtained information has been analyzed descriptively-analytically.
Findings and conclusion: In both systems of criminal policy, the application of criminal repression, as the last resort in the chain of legal measures, is exclusively within the jurisdiction of the competent national courts; With the difference that in Iran's legislative criminal policy, its role is more prominent than the European Union and has created challenges. Nevertheless, the attention of both criminal policy systems to the need for diversity of response measures to the so-called criminal phenomenon is inconceivable and has led to the prediction of mechanisms based on non-criminal repression.
