چکیده:
با اینکه نظریهپردازان غربی، اصل تعیین سرنوشت را خوانشی از نظامهای مبتنی بر اندیشههای لیبرال دموکراسی و پیشفرضی برای حقوق و آزادیهای فردی تلقی میکنند، این اصل در سویۀ فکری علامه نایینی و علامه جعفری از وضع متفاوت تأسیسی برخوردار است. سنت فکری آنها متأثر از گزارههای موضوعی فقه شیعی مبتنی بر اندیشههای درونفهم دینی است. از اینرو، چنین سازوکاری هم در مبنا و هم در صورت، با نظریات سیاسی در غرب به طریق بنیادینی و موضوعی با تضاد مواجه است و ظرفیتهای گفتمانی خاص خود را دارد. هدف پژوهش حاضر، بررسی حق تعیین سرنوشت مردم در پرتو حقوق اساسی و با رویکرد اجتهادی از منابع موضوعی و با درک فقاهتی و تتبع از تاریخ سیاسی اسلام در میان شیعیان است. سیرِ پژوهشی این مقاله کیفی و توصیفی-تحلیلی و با توجه به موضوع و ماهیت با پشتوانۀ اسناد، شیوۀ آن کتابخانهای است. نتایج نشان میدهد علامه جعفری بهلحاظ مبناشناسی، حاکمیت الهی را هستۀ اصلی مردمسالاری و از حیث صورت آن را از شقوق بااهمیت حیات معقول انسانی میداند. حال آنکه فصل تعیینکننده و بالفعل آن به اعتقاد نایینی، حق انتخاب و دادن فرصت برای عموم یا جمهور مردم در تأیید مشروعیت حاکمیت است.
Issue: The principle of self-determination that Western theorists view as a reading of liberal-democracy systems and presuppositions of individual rights and freedoms. In thoughts of the Naini and Ja'fari have been different. Such a mechanism, both fundamentally and in the case of political theories in the West, is fundamentally confronted with the paradox. Objective:The main purpose of this study is to examine the right to self etermination in the light of the fundamental rights deriving from a common theoretical core by two thinkers in shites.Method: This research is a qualitative and descriptive-analytical research that in rgarded to the subject matter and the nature of the documents, have been chosen the library method.Conclusion: The results of the study been showing Ja’fari in the basis, the principle of theochratic sovereignty, has been the core of the value-based democracy and in the face of it, he considers it to be of the importance of reasonable human life. However, the decisive chapter is actually Naini's belief in the right to choose and give the public or the people the opportunity to affirm the legitimacy of sovereignty.
