چکیده:
زمینه و هدف: نیروهای مسلح به عنوان بازوهای اجرایی کشور در تأمین امنیت داخلی و خارجی مشغول انجام وظایف تعیین شده خود هستند. تخطی از این وظایف مسئولیت کیفری و مدنی برای آنان به همراه دارد. تحقیق حاضر با رویکرد تطبیقی، مسئولیت مدنی نیروهای مسلح در مقام اعمال حاکمیت را در نظام حقوقی ایران و ترکیه بررسی می کند.روش: تحقیق حاضر توصیفی–تحلیلی از طریق فیش برداری و رجوع به منابع موجود می باشدیافته ها: یافته های تحقیق بیانگر آن است که نیروهای مسلح در اعمال حاکمیت، از مصونیت نسبی برخوردارند، زیرا دامنه و نتایج حاصل از اعمال حاکمیتی نیروهای مسلح، فراتر از نیروهای مسلح و با امنیت و نظم عمومی جامعه گره خورده و براساس قوانین موضوعه، نیروهای مسلح در موارد اعمال حاکمیت، در صورت رعایت قوانین و مقررات مربوطه و عدم قصور و سهل انگاری و ورود خسارت، مسئولیت کیفری و مدنی ندارند. با وجود اینکه قوانین و مقررات مرتبط با مسئولیت نیروهای مسلح، در مواردی از قواعد مسؤولیت مدنی منصرف شده، لیکن قاطبه قوانین موجود بر جبران خسارات وارده تأکید نموده اند. در قوانین و مقررات کشور ترکیه نیز با تکیه بر قواعد عمومی مسئولیت مدنی، موادی از قانون اساسی و سایر قوانین آن کشور، نیروهای مسلح را در مقام اعمال حاکمیت در صورت تطبیق اقدامات آنان با قوانین و مقررات، مصون از مسئولیت کیفری و مدنی دانسته و در صورت ورود خسارت ناروا و غیر قانونی به شهروندان، دولت را مکلف به جبران خسارت وارده دانسته است.نتایج: با بررسی تطبیقی رویکرد نظام حقوقی دو کشور ایران و ترکیه به موضوع مسئولیت های مدنی ناشی از اعمال حاکمیتی نیروهای مسلح مشخص گردید، مهمترین چالش موجود در این زمینه در ایران، نبود قوانین مستقل و اختصاصی برای نیروهای مسلح با وجود گستردگی مأموریت های آنان در راستای اعمال حاکمیت است. به نحوی که اگر مقنن ایران بتواند همانند مقنن ترکیه، شرایط خاص نیروهای مسلح به خصوص مأموریت های آنان در بکارگیری سلاح و... را از قوانین عام مسئولیت تفکیک کرده و تابع ضوابط جدیدی قرار دهد، مسلماً باعث افزایش حمایت از نیروهای مسلح در مقام اعمال حاکمیت و افزایش سرعت و دقت رسیدگی به این پرونده ها توسط دستگاه قضایی خواهد شد.
Background and purpose: The armed forces, as the executive arms of the country, are busy performing their assigned duties in providing internal and external security. Violation of these duties brings criminal and civil liability for them. With a comparative approach, the present research examines the civil responsibility of the armed forces in the role of exercising sovereignty in the legal system of Iran and Turkey. Method: The present research is descriptive-analytical through sampling and referring to the available sources. Findings: The findings of the research show that is that the armed forces enjoy relative immunity in the exercise of sovereignty, because the scope and results of the exercise of sovereignty of the armed forces are beyond the armed forces and are tied to the security and public order of the society, and based on the relevant laws, the armed forces, in cases of exercise of sovereignty, They do not have criminal or civil liability if they comply with the relevant laws and regulations and there is no negligence and no damage. Although the laws and regulations related to the responsibility of the armed forces, in some cases, the rules of civil responsibility have been abandoned, but the existing laws have emphasized on compensation for the damages. In the laws and regulations of the country of Turkey, relying on the general rules of civil liability, articles of the constitution and other laws of that country, the armed forces are immune from criminal and civil liability in the capacity of exercising sovereignty if their actions comply with the laws and regulations. In case of unlawful and illegal damage to the citizens, the government is obliged to compensate for the damage. Results: By comparing the approach of the legal systems of Iran and Turkey to the issue of civil responsibilities resulting from the sovereign acts of the armed forces, it was determined that the most important challenge In this context, in Iran, there is a lack of independent and specific laws for the armed forces despite the extent of their missions in line with the exercise of sovereignty. In such a way, if the Iranian legislator can, like the Turkish legislator, separate the special conditions of the armed forces, especially their missions in the use of weapons, etc., from the general laws of responsibility and make them subject to new rules, it will certainly increase the support for the armed forces in the position The judicial system will apply the rule and increase the speed and accuracy of handling these cases.
