چکیده:
هوشمصنوعی، نمونهای از سیستمهای تصمیمگیری الگوریتمی، که قادر است تا با طبقهبندی اطلاعات ورودی و الگویابی، اطلاعات و وقایع آتی را پیشگویی و در خصوص آنها تصمیمات مقتضی اتخاذ نماید و در حوزههای مختلفی بهبهرهبرداری رسیدهاست. پیشرفت این حوزه تا جاییست که، فرض سیستمی الگوریتمی با قابلیت تحلیل و ارائه راهحل برای مسئلهای حقوقی، نهتنها بعید نیست، بلکه در برخی کشورها در ابعاد محدودی مورد استفاده قرار گرفتهاست. چنانچه پدیدآور، سیستم را با اطلاعات ورودیِ مربوط بهقوانین بهمعنای عام، پیشینة تصمیمات قضایی، نظریات مشورتی، در کنار نظرات حقوقی آموزش دهد، و یادگیری ماشین و الگویابی با نظارت حقوقدانان صورت بگیرد، سیستم میتواند در مواجهه با یک مسئله حقوقی، بسان یک متخصص گرهگشایی کند؛ چراکه با اطلاعات جامعی که در اختیار دارد، اعم از دانش حقوقی و تجربیات قضایی، اطلاعات موجود در مسئله جدید را تحلیل میکند، و راه موثقی برای حل مسئله ارائه میدهد. پژوهش حاضر نخستین گامهای این حوزه را با بهرهگیری از تجربیات کنونی در ایالات متحده آمریکا، کشورهای اروپایی و چین برمیدارد، پس از آشنایی با سیستمهای الگوریتمی، نقش حقوقدانان در طراحی سیستمهای ارائهدهندة خدمات حقوقی را توضیح میدهد، اهمیت استفادهاز سیستمها در ارائه خدمات حقوقی در توسعه هر دو حوزه فناوری و حقوقی، و چالشهای استفادهاز آنها را برای تحقق دادرسی عادلانه بیان میکند.
Artificial intelligence (AI) implication in the legal industry promises numerous advancements as it has already improved other industries, one being the accessibility to lawyers for legal services. AI is an algorithmic decision-making system (ADM) classifying and processing data to generate predictions and decisions. The advancement in ADM and AI technology has enabled some jurisdictions to deploy them as judges, counsels, arbitrators, and prosecutors to limited extents. The main training data developers use to design such systems in Iran are laws and regulations, court judgments, consultative opinions issued by the Iranian judiciary, and legal theories. This research aims to shed light on the importance of ADM and AI in achieving justice and answering demands through a comparative evaluation of challenges Iranian developers encounter in the designing phase and the essentiality of legal scholars’ participation. Then, following instances of ADM and AI deployment in the US, EU, and China, the research elaborates on challenges in the development and deployment phases using experiences in other countries.
