چکیده:
زمینه و هدف: بررسی فقهی حقوقی تحریمهای اقتصادی در راستای ارائه راهکارهای مقابله با این تحریمها امری ضروری است. بر همین اساس پژوهش حاضر به دنبال بررسی راهکارهای فقهی و حقوقی مقابله با تحریمهای اقتصادی است.مواد و روشها: مقاله حاضر توصیفی-تحلیلی است. مواد و دادهها نیز کیفی است و از فیش برداری در گردآوری مطالب و دادهها استفاده شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.یافتهها: بهرهوری، صبر و حسن تدبیر، استفاده حداکثری از ظرفیتها، تشخیص اولویتهای مدیریتی، مقابله به مثل با اهرمهای قدرت و اتحاد و انسجام از مهمترین راهکاری فقهی برای مقالبه با تحریمهای اقتصادی است. در وضعیت کنونی حقوق بینالملل، طرح شکایت مستقیم علیه سازمان ملل، نهادها و اندامهای آن، آنهم به شکلی مطلق و نامشروط منتفی است. با وجود این، در عملکرد سازمانها و نهادهای حقوق بشری ملل متحد میتوان نوعی اعمال نظارت، هرچند غیر مستقیم بر نحوه عملکرد دولت های عضو معاهدات حقوق بشر و اعمال خود سازمان ملل بهویژه در زمینه مجازاتهای اقتصادی مشاهده کرد.نتیجه گیری: از منظر فقهی و اقتصادی راهکارهایی برای مقابله با تحریمهای اقتصادی وجود دارد؛ اما تحقق آنها نیازمند تدیون راهبردهای اقتصادی و حقوقی مناسب است.
Background and Aims: Jurisprudential examination of economic sanctions is necessary in order to provide solutions to deal with these sanctions. Based on this, the current research seeks to examine jurisprudential and legal solutions to deal with economic sanctions.Materials and Methods: This article is descriptive and analytical. The materials and data are also qualitative and data collection has been used.Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.Findings: Productivity, patience and good planning, maximum use of capacities, recognition of managerial priorities, countering the levers of power and unity and cohesion are the most important jurisprudential solutions for dealing with economic sanctions.Nevertheless, in the functioning of the human rights bodies and institutions of the United Nations, it is possible to observe a kind of supervision, albeit indirectly, on the functioning of member states of human rights treaties and the actions of the United Nations itself, especially in the field of economic sanctions.Conclusion: From a jurisprudential and economic point of view, there are solutions for economic sanctions, but their realization requires the development of appropriate economic and legal strategies.
