چکیده:
هدف: سهمخواری به معنی جبران مالی در ازای ارجاع بیمار از جانب پزشک و یا مؤسسات ارائه دهنده خدمات سلامت میباشد. به دلیل نامشخص بودن جنبه های مختلف عمل سهم خواری ، این مطالعه با هدف مشخص شدن جنبه های عمومی،فقهی، حقوقی و اخلاقی سهم خواریانجام شده است. روش بررسی: این مطالعه یک مطالعه کیفی است که از طریق مصاحبه های عمیق فردی با 42 نفراز پزشکان و صاحب نظران و نیز استفتاء از 11 نفر از مراجع عظام تقلید انجام شده است. یافته ها و نتیجه گیری : نتایج مطالعه نشان داد که یک سری عوامل از جمله تعرفه های غیر واقعی خدمات سلامت ، رابطه مالی مستقیم بین پزشک و بیمار و سیستم ارجاع نامناسب موجب بروز این پدیدهها میشود و از طرف دیگر مشخص شد که این عمل دارای تبعاتی از جمله تحمیل هزینه های غیرضروری به بیماران و نظام سلامت و نیز تخریب رابطه بین پزشک و بیمار میباشد. به لحاظ فقهی و حقوقی و اخلاقی نیز طبق نظرات مصاحبه شوندگان و استفتائات به عمل آمده سهم خواری خصوصاً در مواردی که مصالح بیمار در نظر گرفته نشود عملی غیر اخلاقی، غیرشرعی و حتی در شرایطی غیرقانونی است.با رفع عوامل ایجادکننده و نیز وضع مقررات و دستورالعمل های اخلاقی تا حدود زیادی می توان در جهت رفع این پدیده اقدام نمود.
Objectives: Fee splitting is a practice whereby a physician refers a patient to another physician or a healthcare facility and receives a portion of the charge in return.The aim of this study is reveal the socio-cultural, jurisprudencial, legal, and ethical aspects of fee splitting in Iran.
Methods: The study is based on conducting indepth-interview with forty two experts incuding physicians, health policy makers, health insurance managers, jurists, lawyers, and ethicists. To complete the study, Islamic scholars' opinions (fatwa) have been obtained from eleven Grand ayatollahs.
Results and conclusions: the study shows that a number of factors, such as unrealisticmedical tariffs,direct financial relationship between doctor and patient, and lack of proper referral systemmay cause physician to get into the practice offee splitting. It was also found that fee splitting has consequences such as imposing unnecessary expenses on patients and health system, as well as affecting physician-patient relationship negatively.In accordance with experts and Grand Ayatollahs' opinions, fee splitting is an unethical, illegitimate, and in some conditions illegal act, especially in cases where the best interests of patients is not considered.With the elimination of the causative factors and making rules and ethical guideline , it is possible to do a great deal to eliminate fee splitting.
