چکیده:
قاعده تحریم جنگ از اصول بنیادین و از قواعد آمره در اسلام و حقوق بینالملل معاصر است که به موجب آن، کشورها از توسل به زور و دخالت در امور یکدیگر منع شدهاند. بر اساس حقوق اسلام و اسناد بینالمللی هرگونه حمله و توسل به زور تحت عناوینی چون حمله یا دفاع پیشگیرانه در برابر حمله قریبالوقوع ممنوع است. رعایت اصل مذکور، موجب حفظ حاکمیت و استقلال کشورها و موجب صلح و امنیت بینالمللی خواهد شد. اصولاً دیدگاه اسلام و حقوق بینالملل، کاهش آثار شوم جنگ و برداشتن گام مؤثر در حذف آن است؛ ولی از آنجا که این امر ممکن نیست، تلاش شده است تا پیامدهای جنگ محدود شود. از جمله این تلاشها، تعیین مقرراتی است که در زمان درگیریهای مسلحانه و دفاع، طرفین تخاصم باید آنها را به عنوان حقوق بشردوستانه رعایت کنند. این موضوع هم در اسناد، کنوانسیونها و قطعنامههای بینالمللی اشاره شده است. پس از انقلاب اسلامی، قانونگذار با تأسی از فقه اسلام و حقوق بینالملل، هرگونه عملیات و حمله بدون امر و اجازه یا بدون اینکه به عملیات متقابل وادار شده باشد و یا پس از دستور توقف، جنگ را در اراضی یا علیه نیروهای نظامی یا اتباع دولتی که با ایران در حال جنگ نیست در مواد 34 و 35 قانون مجازات جرایم نیروهای مسلح اقدام خودسرانه تلقی و برای فرماندهان مجازات سنگین در نظر گرفته است که ایرادهایی براین مواد وارد و اصلاح آن جهت رفع ایرادها پیشنهاد میشود. همچنین ضمن بیان مبانی نظری اسلام و حقوق بینالملل، این پرسش مطرح است که آیا حقوق نظامی ایران به این مهم توجه داشته یا خیر؟ و میتواند بر صلح بینالمللی تأثیرگذار باشد؟ نویسنده با استفاده از شیوه تبینی و تحلیلی در صدد محاسن و معایب آن و پاسخ به سؤال این مقاله است. روش این تحقیق هم تحلیلی توصیفی با ابزار گردآوری کتابخانهای است.
The Rule of Prohibition of War is a fundamental principle and an authoritative law in Islam and contemporary international law, based on which, countries are prohibited from waging wars and resorting to force to interfere with each other’s affairs. Consistent with Islamic laws and international law documents, any invasion or resort to force under such headings as preventive measures or defense against an imminent attack is prohibited. The observance of the said principle helps preserve the sovereignty and independence of the countries and establishes international peace and security. In essence, from the Islamic perspective and international law, reducing the consequences of war and its impacts are positive measures aimed at eliminating wars; however, since this is impossible, attempts are made to limit the outcomes of the wars. These measures include determining rules and regulations as humanitarian laws, which the parties should observe during armed conflicts or defense. This issue has also been set out in international documents, conventions and resolutions. Following the Islamic Revolution, the legislator, citing the Islamic jurisprudence and international law, has envisaged any unauthorized or unpermitted invasion or military action without counter-measures or following the order of cessation against military forces or nationals who are not in conflict with Iran to be arbitrary as outlined in Articles 34 and 35 of the Criminal Code of the Armed Forces, setting out heavy punishment for the commanders. These laws have problems, and they need to be modified. This research also expressed theoretical basics of Islam and international laws to ask: Have the Iranian military laws paid attention to this? Furthermore, can they affect international peace? Here, the author uses an explanatory and analytical method to enumerate the advantages and disadvantages of this issue and uses a descriptive-analytical method via library sources to gather data.
