چکیده:
اضطرار یکی از عناوین ثانویه در فقه شیعی است که بخاطر آن حکم اولیه برداشته می شود و اضطرار گاهی در فعل و گاهی در ترک امری می باشد و به سخن دیگر؛ اضطرار به مجبور شدن به انجام ارادی فعل با عدم رضایت قلبی، یا سلب کامل اختیار اطلاق میشود. اضطرار به بیم از زیان غیر قابل تحمّل نسبت به فعل یا ترک گفته میشود. اضطرار، حالتی است که در آن، با وجود آن که تهدیدی از خارج متوجه شخص نمیگردد، فشاری از درون وی، او را به انجام کاری وادار میکند که نسبت به آن رضایت کامل ندارد؛ یعنی هر چند اراده انجام آن را دارد، اما این اراده با رضایت و خرسندی درونی همراه نیست، مانند این که شخصی برای درمان فرزندش، مضطر به فروش خانه خود میگردد؛ در این مورد، او این کار را بر خلاف میل باطنی و در شرایط اضطرار، ولی با اراده و قصد ، انجام میدهد. فقها عمده بحث را در کتاب اطعمه و اشربه آورده اند. ریشههای اضطرار، اکراه، تقیّه، ضرر و ضرورت است در مقاله حاضر، به بررسی دیدگاه فقها و تحولات این دادگاه از گذشته تا کنون میپردازیم. روش مقاله، توصیفی تحلیلی است. هدف، شناسایی دیدگاه مستدل و موجه در میان فقهاست. نتیجه مقاله، نشان از برتری دیدگاه آیتاله خوئی نسبت به دیگر فقها دارد.

Emergency is a state in which, despite the fact that there is no external threat to a person, a pressure from within him forces him to do something that he is not completely satisfied with; That is, although he has the will to do it, but this will is not accompanied by inner satisfaction and satisfaction, like when a person is forced to sell his house to treat his child; In this case, he does this against his inner desire and in emergency conditions, but with will and intention. The jurists have given the main discussion in the book of eating and drinking. The roots of urgency are reluctance, piety, harm and necessity. In this article, we will examine the views of jurists and developments of this court from the past to the present. The method of the article is descriptive and analytical. The goal is to identify the reasoned and justified point of view among jurists. The result of the article shows the superiority of Ayatollah Khoi's view compared to other jurists.
