چکیده:
زمینه و هدف؛ در گفتمان زنان، نظام عدالت کیفری با غلبه ی رویکرد مردسالارانه و عدم توجه کافی به دغدغهها و ملاحظات زنان، الگویی شکست خورده در حمایت از زنان بزه دیده تلقی میشود. در این تحقیق برآنیم جرم انگاری خشونت علیه زنان در حقوق جزای ایران و حقوق جزای بین الملل مورد مطالعه قرار دهیم. روش پژوهش؛ در این پژوهش چگونگی جرم انگاری خشونت علیه زنان در حقوق جزای ایران و حقوق جزای بین الملل به شیوه تطبیقی– تحلیلی هم از منظر حقوق داخلی و هم بین الملل از طریق کتابخانهای بررسی شده است. یافتههای پژوهش؛ بیانگر این است که نظام عدالت کیفری با جرم انگاری و رویکرد سخت گیرانه، میتواند عملکرد مناسب تری در قبال بزه دیدگی زنان در خشونت خانوادگی داشته است، لیکن بررسیها نشان میدهد عدم توجه کافی به امنیت زنان، عدم توازن قدرت، اصرار بر بخشش، تحت تاثیر قرار دادن فرایند توسط بزهکار، سهلگیری بر مجرمان مرد و عدم پاسخگویی کافی آنان و در نتیجه عدم بازدارندگی عام و خاص، تقویت هنجارهای فرهنگی مردسالارانه و غیره، از جمله مهمترین چالشهای پیش روی عدالت کیفری است.
Background and Purpose; In women's discourse, the criminal justice system is considered a failed model in supporting the victimized women due to the dominance of the patriarchal approach and insufficient attention to women's concerns and considerations. In this research, we aim to study the criminalization of violence against women in Iranian criminal law and international criminal law.
research method; In this research, the criminalization of violence against women in Iranian criminal law and international criminal law has been investigated in a comparative-analytical way from the perspective of both domestic and international law through a library.
research findings; It indicates that the criminal justice system, with its criminalization and strict approach, can have a more appropriate performance in relation to women's victimization in family violence, but studies show that insufficient attention is paid to women's safety, imbalance of power, insistence on forgiveness, under the influence of Placing the process by the criminal, neglecting male criminals and their lack of sufficient accountability, and as a result, the lack of general and specific deterrence, the strengthening of patriarchal cultural norms, etc., are among the most important challenges facing criminal justice.
