چکیده:
زمینه و هدف - انتقال محکومین و استرداد مجرمین اقتصادی یکی از ابزارهای معاضدت بین المللی در امور کیفری است که از دیرباز به موجب قراردادهای دو یا چندجانبه در روابط میان کشورهای مختلف مورد استفاده قرار می گرفته است. افزایش بزه کاری چه در سطح ملی تحت عناوین فسادها و اختلاس های کلان مالی و پزیرش تابعیت سایر کشورها و چه در سطح فراملی، کشورهای عضو را به چالشی جدید در پیکار با این پدیده کشانده و این نارسایی های به دلیل اصل سرزمینی بودن جرایم و اصل صلاحیت رسیدگی به جرایم اتباع کشور و تعارض استرداد با قاعده نفی سبیل در عرصه جزایی بیشتر خودنمایی می کند، که ممکن است وقوع عمل مجرمانه در سرزمین یک دولت، با لحاظ عناصر بین المللی، منجر به اختلاف دو یا چند دولت با دادگاه های بین المللی و یا حتی دادگاههای بین المللی با همدیگر در ادعای اعمال صلاحیت رخ دهد. در این حال، کدام دادگاه داخلی یا بین المللی، صلاحیت رسیدگی دارد؟ آیا سلسله مراتبی بین انواع صلاحیت های کیفری دادگاه های ملی و بین المللی وجود دارد؟ چگونه می توان تعارض بین دولت های متقاضی را اعمال کرد؟ آیا تفاوتی دراستراد محکومین با استرداد متهمین اقتصادی با عنایت به تاکید بر قاعده ی نفی سبیل وجود دارد؟ مقاله حاضر توصیفی تحلیلی بوده و با استفاده از روش کتابخانه ای به بررسی سوالات مورد اشاره پرداخته است. یافتهها بیانگر این است که در صورت تمسک به قاعده نفی سبیل نه تنها صلاحیت رسیدگی را از سایر کشورها سلب می کنیم - بلکه با موضوع مهم بی کیفر مانی مجرمان اقتصادی مواجه می شویم. مجرمانی که مستلزم راهکارهای جدی تری برای دستگیری و استرداد آنها هستیم، باعث تسهیل در عدم استراد و محاکمه و در نتیجه بی کیفرمانی آنها می شویم. از سویی پاسخ به این سوال در گرو، ارزیابی علمی قاعده مجرمیت متقابل به عنوان یک قاعدة حقوق بشری، ابزارهایی جایگزین استرداد همچون قرار جلب در روابط بین برخی از کشورها، مرزبندی میان محکومین و متهمین در قراردادهای استرداد بین المللی، با راه حل هایی همچون صلاحیت برتر، قاعدة «یا محاکمه کن یا مسترد کن»، استردادمجرمین اقتصادی، منع تعقیب مجدد، جایگزینی همزیستی مسالمت آمیز با قاعده نفی سبیل بعنوان رویکرهای مهم در عرصه حقوق جزای بین الملل مطرح شده است که در این مقاله به تحلیل آن پرداخته می شود.
Background and Purpose; The transfer of convicts and the extradition of economic criminals is one of the tools of international assistance in criminal matters, which has been used for a long time by bilateral or multilateral agreements in the relations between different countries. The increase in crime both at the national level under the headings of corruption and large-scale financial embezzlement and the denial of the citizenship of other countries and at the transnational level has led the member countries to a new challenge in the fight against this phenomenon, and these inadequacies are due to the territorial nature of crimes and the principle Jurisdiction to deal with the crimes of nationals of the country and the conflict of extradition with the rule of negation of the mustache is more evident in the criminal field, where the occurrence of a criminal act in the territory of a state, in terms of international elements, may lead to a dispute between two or more states with international courts and or even international courts with each other in claiming to exercise jurisdiction. Meanwhile, which domestic or international court has jurisdiction? Is there a hierarchy between the types of criminal jurisdictions of national and international courts? How can conflicts between applicant states be enforced? Is there a difference in the return of convicts with the extradition of economic defendants, considering the emphasis on the rule of negation of the mustache? The present article is descriptive and analytical and has investigated the mentioned questions using the library method. The findings indicate that if we adhere to the rule of negation of the mustache, we not only deprive other countries of jurisdiction; Rather, we face the important issue of impunity for economic criminals. Criminals who require more serious measures to arrest and extradite them, we make it easier for them not to be extradited and tried, and as a result, they go unpunished. On the one hand, the answer to this question depends on the scientific evaluation of the rule of mutual guilt as a rule of human rights, alternative means of extradition such as the agreement in relations between some countries, demarcation between convicts and accused in international extradition agreements, with solutions such as Superior jurisdiction, the rule of "try or extradite", extradition of economic criminals, prohibition of re-prosecution, replacement of peaceful coexistence with the rule of negation of the mustache have been proposed as important concepts in the field of international criminal law, which are analyzed in this article
