چکیده:
زمینه و هدف: یکی از قواعد و اصول مهم در حیطه قراردادها اصل لزوم است. پرسش مقاله حاضر این است که اصل لزوم در تعهدها و قراردادهای بینالمللی در پرتو اصل پایبندی به عقود در فقه و حقوق چگونه قابل تبیین است؟ هدف مقاله یافتن پاسخ به پرسش مذکور است.مواد و روشها: روش تحقیق توصیفی-تحلیلی است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.یافتهها: یافتهها نشان داد اصل لزوم در فقه پذیرفتهشده است. اصل وفای به عهد، اصل استصحاب و بنای عقلا از جمله مبانی فقهی اصل لزوم است. در قانون مدنی نیز از دید عموم حقوقدانان ماده۱۹۰ قانون مدنی بر اصل لزوم دلالت دارد. تعیین وضعیت عقد یا آثار احتمالی آن، تردید در وجود حق فسخ و تردید در مدت حق فسخ از مهمترین کاربردهای اصل لزوم در قانون مدنی است. اصل لزوم به معنای آنچه در فقه و حقوق ایران مطرح است در تعهدات و قراردادهای بینالمللی مطرح نیست. در تعهدات و قراردادهای بینالمللی، اجبار به اجرای عین تعهد مطرح است؛ اما اصل اجباری بودن عقود با اصل لزوم که در فقه مورد بررسی قرار گرفته است یکسان نیست.نتیجهگیری: در قراردادهای بینالمللی، اصل لزوم به معنای ضرورت اجرا و ایفای تعهدات مفروض است. مطابق اصل اجباری بودن عقود یا نیروی الزامآور عقد، اعم از لازم و جایز، تا زمانی که باقی است باید اجرا شود. پس این اصل به عقد لازم اختصاص ندارد و عقد جایز هم تا زمانی که فسخ نشده است باید اجرا شود و به تعبیری لازم الاتباع است.
Context and purpose: The principle of necessity is one of the most important rules and principles in the field of contracts. The question of this article is that how can the principle of necessity in international obligations and contracts be explained in the light of the principle of adherence to contracts in jurisprudence and law? The purpose of the article is to examine the mentioned question.Materials and methods: This paper is descriptive and analytical method.Ethical considerations: In this paper, the originality of the texts, honesty and trustworthiness are respected.Findings: The principle of necessity is accepted in jurisprudence. The principle of keeping one's promise, the principle of companionship, and the foundation of wisdom are among the jurisprudential foundations of the principle of necessity. In the civil law, from the point of view of the general jurists, Article 190 of the civil law implies the principle of necessity. Determining the status of the contract or its possible effects, doubting the existence of the right of rescission and doubting the duration of the right of rescission are among the most important applications of the principle of necessity in civil law.Conclusion: In international contracts, the principle of necessity means the necessity of implementing and fulfilling assumed obligations. Therefore, this principle is not specific to the necessary contract, and the permissible contract must be implemented until it is terminated, and in a sense, it is mandatory for the subjects.
