چکیده:
زمینه و هدف: یکی از معضلاتی که ممکن است گریبانگیر هر سازمان ملی یا بینالمللی شود، حلوفصل اختلافهای مربوط بهآن می باشد. در خصوص سازمان بینالمللی مالکیت فکری یعنی «وایپو»، نیز امروزه این مسئله که توسل به داوری تا چه حد در حل وفصل اختلافات این سازمان مؤثر است حائز اهمیت است. مواد و روش ها: این تحقیق از نوع نظری و روش تحقیق به صورت-توصیفی تحلیلی است. روش گردآوری اطلاعات به صورت کتابخانه ای است و با مراجعه به اسناد، کتاب ها و مقالات صورت گرفته است. یافته ها: در یک نگاه کلی، دلایل رجوع به داوری از جمله کم هزینه بودن، آسان بودن، حفظ محرمانگی، تخصصی شدن، سرعت و ... همچنین موجبات استفاده از این نهاد در حوزه مالکیت فکری حائز اهمیت است و از این طریق است که میتوان توجیههای مناسبی برای استفاده از این سازوکار در حلوفصل اختلافات درباره وایپو داشت. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه گیری: امروزه بسیاری ترجیح میدهند که قوانین داوری وایپو را بر سایر روش های پر هزینه دادگاهی و طرح دعوی انتخاب کنند و در نتیجه قوانین و آئینهای رسیدگی مدونی در این حوزه به وجود آمدهاند.

Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings: In a general view, the reasons for referring to arbitration, including low cost, ease, maintaining confidentiality, specialization, speed, etc., as well as the reasons for using this institution in the field of intellectual property, are important and in this way, it can be had proper justifications for using this mechanism in resolving disputes about WIPO. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: Today, many prefer to choose WIPO's arbitration rules over other costly court and lawsuit methods, and hence the rules and regulations of written proceedings in this area have been created.
