چکیده:
تبعیض در دنیا امروزی به شدت محکوم بوده و در هیچ جامعه بین المللی مورد پذیرش نمیباشد به طوری که در ماده 2 اعلامیه جهانی حقوق بشر 1948 به صراحت ذکر گردیده: «هرکس میتواند بدون هیچ گونه تمایز، مخصوصا ازحیث نژاد، رنگ، جنس، زبان، مذهب، عقیده سیاسی یا هرعقیده دیگر و همچنین ملیتها، وضع اجتماعی، ثروت، ولادت یا هر موقعیت دیگر ازتمام حقوق وکلیه آزادیهایی که دراعلامیه حاضر ذکر شده است بهره مند گردد. به علاوه هیچ تبعیضی به عمل نخواهد آمد که مبتنی بر وضع سیاسی، اداری، قضایی یا بین المللی کشور یا سرزمینی باشد که شخص به آن تعلق دارد، خواه این کشور مستقل، تحت قیمومت یا غیر خود مختار بوده یا حاکمیت آن به شکلی محدود شده باشد»، این موضوع تا جایی توسعه یافته که رعایت مسائل حقوق بشری در حوزه ورزش نیز تسری یابد و در سال 1985، کنوانسیون بین المللی ضد آپارتاید ورزشی تصویب و تبعیض را تحت هیچ شرایطی جایز نداند. اما دولتها حسب روابط سیاسی خود با سایر دولتها در قراردادهای ورزشی برخلاف اصل رفتار ملی عمل کرده و موجبات اعتراض و شکایت به کمیته بین المللی المپیک را فراهم مینمایند که کنوانسیون حاضر و سایر اسناد بین المللی در حوزه حقوق بشر، مانع و محدودیت بزرگی بر رویکرد دولتها بوده و تاثیر به سزایی در رعایت اصل رفتار ملی داشته است.
