چکیده:
Since the 'principle of Haqq al-Ta'ah' plays a special role in practical reason within the ijtihadi thought of Shahid Sayyid Mohammad Baqir al-Sadr, he establishes it as a systemic element upon which the entire science of Usul is shaped, rather than merely as a methodology applicable only to the practical principles (Usul al-Amaliyyah)—a limited application that is also negated by the introduction of legal exoneration (Bara'at Shar'i). A view that restricts Haqq al-Ta'ah to the discussions of practical principles effectively turns it into an intellectual idea that has no special role in the science of Usul, whereas Haqq al-Ta'ah is a methodology and a path. The application of these titles to Haqq al-Ta'ah demonstrates its importance for the science of Usul. According to the claim of this article, Haqq al-Ta'ah is not only in the practical principles but stands at the forefront of the science of Usul, influencing all parts of this knowledge, from discussions of certainty (Qat') to conjectures (Zunun), authority (Hujjiyyah), and ijtihadi evidences. Such an intellectual principle that transforms the scientific methodology can also be called a systemic element. Formulating the principle of Haqq al-Ta'ah as a systemic element requires demonstrating how the organizational structure of the science of Usul is built upon it, and how the fundamental elements of the science of Usul and their sub-components are shaped and explained based on this principle. In addition to the structure of the science of Usul, naturally, the concepts and contents of this science, such as discussions related to evidences, authority, and practical principles, will undergo transformation and expansion. Furthermore, as a regulating element of ijtihadi data, this principle, in addition to resolving other fundamental problems of the organizational structures of the science of Usul, adds a new capability to ijtihadi knowledge and the science of Usul, and thus moves the history of ijtihadi knowledge one step forward.

The Centrality of Haqq al-Ta'ah in the Science of Usul 1 Hadi Mousavi 2 Sayyid Hamidreza Hasani Abstract Since the "Principle of Haqq al-Ta'ah" plays a special role in the practical intellect within the ijtihadi thought of Shahid Sayyid Muhammad Baqir al-Sadr, it establishes it as a systemic element upon which the entire science of Usul is shaped, rather than merely as a methodology that applies only to the practical principles (Usul al-Amaliyyah), an application that is also negated by the introduction of Shari'i exoneration (Bara'at Shar'i).
According to the claim of this article, Haqq al-Ta'ah is located not only in the practical principles but at the forefront of the science of Usul, and it brings all parts of this knowledge, from the discussions of certainty (Qat') to conjectures (Zunun), authority (Hujjiyyah), and the evidences of ijtihad (Adillah al-Ijtihadiyyah), under its influence.
ir Introduction Without the most important claim of the present article, it is that the principle of Haqq al-Ta'ah, in Shahid al-Sadr's science of Usul, does not only function in the section of practical principles (Usul al-Amaliyyah) as a rival to rational exoneration (Bara'at Aqli) and against the rule of 'the ugliness of punishment without clarification' (Qubh al-Iqab bila Bayan), but rather this principle holds a higher position in the science of Usul.
