چکیده:
The aim of this research is to examine the role of the government in the Iranian economy from the perspective of an economist, in the light of law and economics literature, but with a systems management attitude, and to study the efficiency of the Constitution of the Islamic Republic of Iran in this regard. The specific question that this research seeks to answer is: From an Islamic perspective, based on what theoretical covenant have statesmen been called to the sovereignty of the nation, and what potentials for economic growth and development does that social contract (the Constitution) contain? In other words, how are the mechanisms for growth and development embedded in this law? The results indicate that statesmen should strictly implement the provisions of the social contract (the Constitution) and that the rights of the factors of production should be ensured. Economic growth, justice, and efficiency in Iran are achievable.

Efficiency of the Constitution in Providing Economic Rights Laying the foundation of the legal structure: Based on Article 41 of Principle 3 of the Constitution, the government is obliged to take all necessary measures to provide comprehensive rights for individuals, both men and women, and to create fair judicial security for all and equality of the public before the law; and based on Principle 22 of the Constitution, complete economic, social, political, and cultural security for all people is guaranteed.
Article 651 of the Constitution states in this regard: 'The Judiciary is an independent power that supports individual and social rights, is responsible for realizing justice, and is in charge of the following duties:\ 1- Investigating and issuing rulings regarding grievances, transgressions, complaints, settling disputes and resolving conflicts, making decisions and taking necessary actions in that part of the administrative affairs (umur hasbiya) that the law specifies.
Article 154 of the Constitution has obligated the sovereignty of the country to expand health services to the farthest points of the world; so that, to prevent domination, it provides necessary support for the struggle or reformist efforts of the oppressed of the world, whether culturally, economically, socially, politically, or militarily; its text is as follows: "The Islamic Republic of Iran considers the happiness of mankind in the entire human society as its ideal and recognizes independence, freedom, and the rule of right and justice as the rights of all people in the world.
