چکیده:
هدف
این پژوهش با هدف شناسایی آثار و چالش های ناشی از کرونا در زمینه بیمه های دریایی و میزان پوشش خسارات و نیز تبیین راه کارهای قابل اعمال به منظور کمک به رفع این چالش ها و تعیین سیاست های پیشگیرانه در طولانی مدت برای غلبه بر بحران های مشابه احتمالی در آینده انجام شده است.
روش شناسی
این پژوهش به شیوه توصیفی-تحلیلی تنظیم و مطالب به صورت کتابخانه ای و با جستجو در کتب و مقالات حقوقی، قوانین و پایگاه های اینترنتی مرتبط گردآوری شده است.
یافته ها
صنعت دریانوردی و کشتیرانی نقش مهمی در حمل ونقل دریایی دارد؛ زیرا بیشترین حمل ونقل در دنیا از طریق دریا و به وسیله کشتی انجام می شود؛ اما از دیرباز تاکنون، سفرهای دریایی همیشه با مخاطراتی همراه بوده که منجر به ورود خسارت به کالا، کشتی و یا سرنشینان آن می شده است؛ بنابراین مالکین کشتی ها همواره در پی دست یابی به راهکارهای مناسبی برای جبران خسارات وارده بوده اند که درنهایت انعقاد قرارداد بیمه با بیمه گران دریایی را بهترین راه حل و پشتوانه مالی یافتند و بدین ترتیب موفق به بیمه کردن کشتی، کالا و مسیولیت در مقابل شخص ثالث توسط بیمه گران انتفاعی و انجمن های حمایت و غرامت شدند. در اواخر سال 2019 پدیده نوظهوری به نام ویروس کرونا به وجود آمد که به سرعت در سطح دنیا شیوع پیدا کرد. به دنبال همه گیری گسترده ویروس کرونا، دولت ها سعی کردند با وضع مقررات محدودکننده از قبیل تعطیلی اجباری، قرنطینه، محدودیت های سفر و بستن مرزها، مانع شیوع بیشتر این ویروس جدید شوند. لذا، در پی این محدودیت ها، سطح وسیعی از فعالیت های تجاری در جهان کاهش یافت و موجب کاهش حمل ونقل به ویژه در حوزه دریایی شد که نهایتا خسارات متعددی به مالکین کشتی ها وارد ساخت؛ زیرا محدودیت های اعمال شده منجر به کاهش نیروی انسانی، تاخیر در بارگیری، ترخیص و تحویل کالا، ورود خسارت به محموله ها به ویژه کالاهای فاسدشدنی، تاخیر در تعمیر، سرویس و بازرسی کشتی ها و همچنین منجر به از دست دادن اجاره بهای کشتی شد و باید هزینه های مربوط به قرنطینه، بیماری یا مرگ دریانوردان، هزینه های بازگشت و جایگزینی، مسیولیت مسافران و هزینه های انحراف را نیز به آن اضافه کرد که در نهایت منجر به بروز مطالبات بیمه ای و ایجاد اختلاف بین بیمه گران و بیمه گذاران خواهد شد.
نتیجه گیری

In late 2019, an emerging phenomenon called the corona virus emerged, which spread rapidly around the world. Following the widespread outbreak of the coronavirus, governments sought to prevent the spread of the new virus by imposing restrictive regulations such as forced closures, quarantines, travel restrictions and border closures. Therefore, as a result of these restrictions, a wide range of commercial activities in the world decreased, and as a result, reduced transportation, especially in the maritime area, which ultimately caused a lot of damage to shipowners; This is because the restrictions imposed have led to a reduction in manpower, delays in loading, clearance and delivery of goods, damage to cargoes, especially perishable goods, delays in repair, service and inspection of ships, as well as loss of ship hire and the costs of quarantine, sickness or death of seafarers, return and replacement costs, passenger liability and diversion costs must be added that these cases will lead to insurance claims and create differences between underwriters and insurers.
