Abstract:
در بیشتر نظامهای حقوقی» قانون اساسی یا قوانین عادی دیگر در برگیرنده مقررات مربوط به تساوی حقوق و دستمزد میباشند؛ اما
معمولاً دامنه اجرایی آنها محدود است. در همین راستا باید بررسی شود که در حال حاضر وضعیت نظام حقوق و دستمزد بر اساس
مسئله زنان متمایز است؟ قوانین کشورها با الگوی مطلوب اشتغال متناسب هستند؟ یا اینکه این قوانین صرفاً در مورد تبعیض آشکار
مور هستند؟ روش مورد استفاده در این پژوهش به صورت کتابخانهای - اسنادی و نوع پژوهش بهصورت توصیفی- تحلیلی
میباشد. طبق ماده ۳۸ قانون کار مصوب ۱۳۹۹ با تبعیت از قانون اساسی، اصل عدم تبعیض در دستمزد کارگر زن و مرد برای کار
مساوی را به رسمیت شناخته است. لیکن با وجود اینکه اصل مزبور در قوانین کلیه کشورهای صنعتی پذیرفته شده است؛ در
کشورهای کره جنوبی و ژاپن که تابع قانون اساسی خود میباشند از لحاظ میزان دستمزد شکافی عمیق بین زنان و مردان وجود
دارد. زنان در آن دسته مشاغلی که به میزان تحصیلات و مهارت یکسان و مشابهی نیاز دارد از تبعیض در مزد رنج ببرند.
In most legal systems the Constitution or other laws includes provisions relating to equal salary
but usually the Executive domain is limited. That’s way it is crushal to study the present State of
Women's salary system distinctive based on women's issue?? Does the current pattern of
employment fit the demanded pattern? Or that these laws are merely effective on the obvious
discrimination? The method used in this research is documentary research method and the type of
research are descriptive- analytical. According to articl 33labour laws Act 1331, conforming to
the Constitution the principle of non-discrimination in for equal work is recognized. However the
equel pay principelis is accepted in all industrial countrys however there is in Iran and the countries
South Korea and Japan, which are enforcers of ther owne constitution.a big hole between wages
for male and female workers. Women in jobs which are different from men, but needs the same
level of education and skills and requirements may suffer wage discrimination
