Abstract:
آگاه نمودن مصرفکننده، تکلیف تولیدکنندگان و عرضهکنندگان و از حقوق مصرفکنندگان میباشد؛ چراکه امروزه کالاهای پیچیدهای در بازار میباشد که مصرفکننده غالباً با طرز استفاده از آنها آشنایی ندارد و بجز افراد متخصص کسی نمیتواند از این کالاها بهرهبرداری بهینه داشته باشد و خطرات آنها را پیشبینی نماید. فلذا به ارائهی اطلاعات فنی و تخصصی ملزماند. مبانی فقهی لزوم ارائه اطلاعات را تایید نموده و با استناد به آن میتوان ساکت خاطی را مسئول شناخت. از جمله این مبانی قاعده غرور است. یافتههای تحقیق نشان میدهد غرور اختصاص به علم شخص غارّ ندارد و در هر صورت مسئولیت دارد. زیرا عالم یا جاهل بودن شخص در رابطه با مسئولیتی که به عنوان حکم وضعی میباشد، تأثیری ندارد. سکوت شخص، به منزلهی فریب از ناحیهی او میباشد. به این صورت که سکوت به عمل فریبزننده، ماهیت غرور را تحکیم مینماید؛ چرا که وی با سکوتش در رابطه با خطرات و عیوب پنهان کالای تولیدی خود، باعث گردیده که مصرفکنندهی ناآگاه قربانی ترک فعل گردد و در نتیجه دچار خسران گردد.

Therefore, they are required to provide technical and specialized information. The jurisprudential principles confirm the necessity of providing information and by relying on it, the wrongdoer can be held responsible. One of these principles is the rule of pride. The research findings show that pride is not limited to the knowledge of the caveman and in any case he is responsible. Because the knowledge or ignorance of a person has no effect on the responsibility that is a situational ruling. A person's silence is a deception on his part. In this way, silence in the deceptive act strengthens the nature of pride; Because by his silence about the dangers and hidden defects of his product, he has caused the uninformed consumer to fall victim to the act and as a result suffer losses.
