Abstract:
به موجب قانون اساسی رییس جمهور در مقابل مردم و مجلس مسئول و پاسخگواست. بنابراین باید برای انجام وظیفه خود اختیار نظارت بر زیر مجموعه خود (هیات وزیران) را داشته باشد. نظارت رییس جمهور بر هیات وزیران به دو صورت مستقیم و غیر مستقیم صورت می گیرد. در نظارت مستقیم رییس جمهور به عنوان رییس بر زیر مجموعه خود نظارت سلسله مراتبی و قیمومتی دارد و می تواند از این طریق با اعمال تصمیماتی از قبیل تذکر، عزل، یا توبیخ وزیر بر کار آن ها نظارت داشته باشد، همچنین می تواند به صورت مستقیم مصوبات وآیین نامه های هیات دولت را مورد بررسی قرار دهد و به اصلاح و یا لغو آن ها مبادرت ورزد. نظارت غیر مستقیم رییس جمهور بر هیات دولت از طریق دفاتر و نهادهای بازرسی، هیات رسیدگی به تخلفات اداری، معاونت های خود صورت می گیرد و علاوه بر آن ضمانت اجراهایی نیز توسط قانون برای مسیولیت وزیران در نظر گرفته شده است. نظارت از طریق دفاتر و نهادهای بازرسی، هیات رسیدگی به تخلفات اداری، معاونت های خود غیرمستقیم بوده و علاوه بر آن ضمانت اجراهایی نیز توسط قانون برای مسئولیت وزیران در نظر گرفته شده است. آنچه در این تحقیق مورد بررسی قرار می گیرد مطالعه نظارت رییس جمهور بر عملکرد وزرا است.
According to the constitution, the president is accountable to the people and the parliament. Therefore, in order to perform its duty, it must have the authority to supervise its subset (the Council of Ministers). The president oversees the cabinet in two direct and indirect ways. In direct supervision the President, as head of his subdivision, he has hierarchical and custodial supervision and may thus supervise their work by making decisions such as warning, dismissing, or reprimanding the Minister, it can also directly review the approvals and regulations of the Cabinet and amend or repeal them. Indirect supervision of the President by the Cabinet is carried out through the offices and inspection bodies, the Administrative Violations Board, and his deputies, in addition, performance guarantees are provided by law for the responsibility of ministers. Supervision through offices and inspection bodies, the Board for Investigation of Administrative Violations, its deputies were indirect, in addition, performance guarantees are provided by law for the responsibility of ministers. What is examined in this study is the study of the President's oversight of the performance of ministers.
