Abstract:
Family formation, as one of the fundamental pillars of social and cultural stability in legal systems, holds special importance. In the Iranian legal system, despite religious and legal emphases on the importance of marriage, numerous legal, economic, and social obstacles have caused a decrease in marriage rates and an increase in family problems. This article, using an analytical-descriptive method, examines the obstacles and limitations of family formation in the Iranian legal system. The findings show that legal limitations, including laws related to dowry (Mehrieh), divorce, and guardianship, economic pressures, and social and cultural transformations are considered among the most important obstacles. Finally, solutions for reforming laws and strengthening social supports are provided.
